Procurement Information
According to the 'The National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) Regulations 2012' NHS England must not restrict the ability of a person to apply for inclusion in the list of patients of the practice of the person's choice. "practice" means the business operated by a contractor for the purposes of delivering primary medical services under Part 4 of the 2006 Act under a contract for the provision of such services. The National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) Regulations 2012 (legislation.gov.uk) Therefore, a patient can choose which general practice of pharmacy they receive the service from. A patient can only receive the services from a GP or Pharmacy who has a contract with the Authority. However, in relation to the evidence for the use of Direct Award Process B, patients have the choice as to which GP or Pharmacy they use, and the Authority does not restrict their choice in this way.
