Summary of the contracting process

Dorset Council procured an integrated all-age substance misuse treatment and recovery service, covering community health provision for people needing support with drug and alcohol use. The service combines treatment, recovery and related support across Dorset. Its scope includes work connected with rough sleepers, families requiring safeguarding support, criminal justice services, and migrant, asylum-seeking and refugee communities. The later modification also brought an Individual Placement and Support Service into the existing service specification. The procurement is complete and has resulted in active awards. The original contract was awarded to Humankind Charity and signed on 18 July 2023 for £23,458,907.87. A further active award is recorded to Waythrough, with a contract signed on 1 November 2023 for £24,762,947 and a duration of 2,310 days. The procedure was limited, using an award without prior publication of a call for competition, under the Public Contracts Regulations 2015; the contract is now governed by the Health Care Services (Provider Selection Regime) Regulations 2023. The contract was modified to add £1,807,545 in funding for existing services and the Individual Placement and Support Service. An earlier modification value is corrected to £503,506 for 2024/25, replacing £512,163.

This VEAT notice is being applied in accordance with The Health Care Services (Provider Selection Regime) Regulations 2023 (the "Regulations") under Regulation 13 in the absence of new notice suites yet to be released. The tender for the All Age Integrated Substance Misuse Service was published in April 2023. At this point commissioners were only able to include known grant funding in the finance schedule. The continuation of grant funding for the services was only confirmed late 2023/early 2024 after the contract had been awarded. However as it was highly likely the funding would be continued, commissioners ensured the contract provided for the inclusion of ongoing grant funding in the service specification as follows: * Rough Sleepers Drug and Alcohol Programme (RSDATG -OHID grant) * Safeguarding Families Together (SFT - DC Children Services) * Criminal Justice Service (Office of Police and Crime Commissioner) * Expectation to work with migrant communities, asylum seekers, and refugees (Dorset Council) The announcement of grant awards are outside of the commissioner's control and the variation to include these services and funding amounts will not render the contract materially different. The grant funding is specifically for the services commissioned from the provider under the existing contract so it is appropriate for the funding to be added to the value of the existing contract. The total value of the modification for 24/25 is PS512,163. The requested modification is lawful under PSR Reg 13(1)(d). This ground applies as the contract was awarded under PCR15 and is not a direct award. In accordance with PSR Reg 13(1)(d), the modification is made at the discretion of the Council and it does not render the contract materially different in character. The modification is to add new funding for existing services provided under the contract. Furthermore, the change in the value of the contract is under 25% of the value when it was entered into. Under Reg 13(4), where a modification is made to a contract without procurement, and that modification is attributable to a decision of the Council and the change in value is over PS500,000 a notice of the modification must be published.
