                    "rationale": "Need for additional works, services or supplies by the original contractor/concessionaire: The contract was procured under The Health Care Services (Provider Selection Regime) Regulations 2023 (PSR 2023), and as such a modification is permissible under Regulation 13(1)(d) of those regulations. This provision states: \"(1) Subject to paragraph (3), a contract or framework agreement for relevant health care services may be modified during its term without following a new procurement process under these Regulations only where-[...] the modification is attributable to a decision of the relevant authority and both of the criteria in paragraph (2) are met.\" The criteria set out in Regulation 13(2) of the PSR are: \"(a) the modification does not render the contract or framework agreement materially different in character, and (b) the cumulative change in the lifetime value of the contract or framework agreement since it was entered into or concluded is- (i) below PS500,000; or (ii) less than 25% of the lifetime value of the original contract or framework agreement when it was entered into or concluded.\" The Council is satisfied that these provisions have been met as the modification is attributable to the decision of the Council, it does not change the nature of the overall contract and is below the relevant threshold provided in Regulation 13(2) of the PSR 2023. The total cost of the modification for the period will be PS75,000.00 and there have been no previous modifications to this contract. The cumulative change in the value of this contract is therefore based solely on this modification and represents a 16% increase."
