Summary of the contracting process

Newcastle City Council has announced a contract extension for the provision of a waste recovery and disposal service. This contract, initially set in 2001, is with SUEZ Recycling and Recovery UK Ltd and pertains to the treatment and disposal of household waste. The procurement stage is in the 'Award' phase as of 15 April 2025, with the existing contract being formally extended for a minimum of two years until 31 March 2028 and a maximum of five years until 31 March 2031. The contract is located within the UKC22 region, specifically at the Byker Resource Recovery Centre in Newcastle. This contract falls under the industry category of 'Refuse and waste related services,' and the procurement method was executed without prior publication of a call for competition due to its limited nature and the immediate need to maintain continuity of service.

This tender extension offers substantial opportunities for businesses involved in waste management and environmental services. Companies specialising in the treatment and disposal of non-recycled waste can benefit from the stability and continuity provided by this contract. Additionally, firms with expertise in adapting to new legislative changes, such as those concerning the UK Emissions Trading Scheme, would find this project particularly suitable. The extended contract allows businesses to secure long-term engagements and positions them advantageously for the projected major procurement involving six other local authorities to design, build, finance, and operate an energy recovery facility. This creates a robust growth prospect for companies capable of offering innovative and compliant waste recovery solutions.

Notice Title

The Provision of a Waste Recovery and Disposal Service

Notice Description

This VEAT notice is in respect of a proposed modification to extend and make a minor amendment to Newcastle City Council's existing contract for the treatment and disposal of household waste. The contracting authority is not awarding a new contract.

Procurement Information

The authority is proposing to execute a variation to its residual waste contract with SUEZ Recycling and Recovery UK Ltd (formerly known as SITA GB Limited) dated 2 April 2001 which it awarded following the publication of a contract notice in the Official Journal of the EU in 1999 (Original Contract). The estimated value of the Original Contract was PS90m (in 2001 prices). This will formally extend the contract for a minimum of two years (terminating on 31 March 2028) and for a maximum of five years (with a long stop expiry date of 31 March 2031). The other minor amendment is to acknowledge the anticipated legislative changes in respect of extension of the UK Emissions Trading Scheme to waste incineration. The contracting authority is currently in procurement (alongside six other local authorities) for a longer-term contractor to Design, Build, Finance and Operate an energy recovery facility for the treatment and disposal of this waste. This limited contract extension will provide flexibility for the contracting authority and ensure continuity of service provision for the treatment of non-recycled waste until such time as the successful contractor takes responsibility for the management of the waste under the new longer-term contract. The contracting authority considers that the modification is permitted by Regulation 71(1)(e) of the Public Contracts Regulations 2015 as a modification which is not substantial. The proposed extension of the contract is based otherwise on substantively the existing terms and conditions and does not render the contract materially different in character, change the economic balance of the contract or considerably extend its scope, The contracting authority does not consider that if the contract had originally been advertised to include this extension that it would have attracted and different participants or candidates or that the outcome of the original procurement would have been any different.
