Notice Description

Radius Housing seek to appoint suitably skilled and experienced Contractors to a Planned Maintenance Contractor Framework Tenderers may apply for a single work Lot, i.e. Lot 1 or Lot 2, or apply for both Lots, subject to fulfilling the Eligibility Criteria as outlined in the CFP Stage 1 Eligibility Questionnaire for each Lot. LOT 1 CYCLICAL MAINTENANCE/MINOR WORKS PROJECTS: Lot 1 will primarily be for planned maintenance type works that are generally of a cyclicanature (ie kitchen replacement, bathroom replacement, window replacement etc) or for other minor works type individual projects which may include adaptations for people with disabilities, extensions, minor internal alterations etc and up to anticipated individual contract value of circa PS750,000.00. however, Radius reserves the right to call-off contract of any value for this lot. In addition to occupied properties, works under Lot 1 may also include void properties where applicable. The indicative estimated annual spend for Lot 1 will be in the region of PS5,000,000.00 to PS8,000,000.00 p.a. LOT 2 MULTI ELEMENTAL IMPROVEMENTS: Lot 2 will be for larger Multi Element Improvement projects. These works will include significant refurbishment works to multiple units and/or communal spaces, or for other works that fall outside of the remit of Lot 1. There is no upper limit for Lot 2 projects, but it is expected that projects will generally range from PS500,000.00 to PS2,500,000.00 (but possible that projects of up to PS5,000,000.00 may occur). However, Radius reserves the right to call-off a contract of any value for this lot. In addition to occupied properties, works under Lot 2 may also include void properties where applicable. The indicative annual estimated spend for Lot 2 will be in the region of PS5,000,000.00 - PS8,000,000.00 p.a. The estimated spend noted above is indicative only and Radius Housing cannot guarantee that these amounts will be spent annually on each Lot. Radius Housing will permit Tenderers to apply for both Lot 1 and Lot 2 or for a single Lot only.

            "features": "This Competitive Flexible shall consist of a number of stages outlined below and explained in further detail throughout this document and in subsequent documents as the procurement exercise will progress: STAGE 1: Conditions of Participation (CoP) The CoP Stage allows for the pre-qualification of Contractors and will provide Radius with sufficient information to allow Contractors to be selected for further stages. Contractors' responses will be evaluated against the criteria set out in these Instructions and the accompanying documents in this CoP Package (CoPP). Contractors must respond to all the questions in the CoPP and must provide all the supporting informationPage 9 to 10 requested. STAGE 2: Tender Stage Contractors short-listed from the pre-qualification process will be invited to participate in a competitive tender process. Shortlisted Tenderers will be issued with comprehensive tender documents which shall provide sufficient information for tenderers to submit a bid. The Award Criteria shall be on the basis of Most Advantageous Tender or Lowest Acceptable Cost. Radius Housing reserve the right to run multiple stages in the procurement competition in order to identify the Most Advantageous Tender. The Tender Stage Instructions will provide full details of this stage. STAGE 3: Post Tender Negotiation (Optional) The Contracting Authority may award the procurement competition to the Most Advantageous Tender / Lowest Acceptable Cost after the assessment Stage 2. The Contracting Authority also reserves the right at its sole discretion following the completion of the evaluation of all responses and the identification of the Most Advantageous Tender / Lowest Acceptable Cost Offer according to the award criteria to enter dialogue with the most advantageous tenderer in order to refine elements of the contract, service, specification, social value offer, sustainability and or cost prior to the execution of the Framework Agreement and or Call Off contracts. Nothing stated in this ITT or during the Competition is or shall be relied on as a promise or representation as to the future or a commitment by the Authority to award or enter into any contract."

                "description": "LOT 1 - AWARD PROCEDURE 1 If Radius Housing decides to source the Services through the Framework Agreement it will award its Services Requirements in accordance with this procedure and the requirements of the Regulations and the Guidance via a Call of Contract. 2 Subject to the provisions of the Framework Agreement, the selection procedure that Radius Housing will use to determine which Tenderer will enter into any Call-Off Contract for its Services Requirements, as set out in a Statement of Requirements (a \"Call Off Contract\") is detailed below. For the avoidance of doubt, in the event that an Tenderer's appointment under the Framework is terminated (in whole or part) or suspended in accordance with the terms of the Framework Agreement, it shall not be eligible to participate in the selection procedure described below, whether by way of a direct award Call of Contract or a mini-competition for award of a Works Package. 3. The following is applicable to Lot 1. (for projects with a pre tender estimate less than PS250K excl VAT in value) DIRECT AWARD A. Projects with a pre- tender estimate construction value less than PS250k It is envisaged that projects and lump sum appointments valued by Radius Housing at less than PS250k will be awarded by way of direct award for the 'Preferred' Lot Tender. However, Radius Housing (acting at its discretion, but within the confines of the Regulations and Guidance) reserves the right to: (a) use the same direct award process for projects Call of Contracts exceeding PS250k in the event of urgency, emergency or other unforeseen circumstances; and (b) use the mini-competition process described in paragraph below where Radius Housing determines that the complexity of services required or that the value of the project or lump sum appointment involved is anticipated to be greater than PS250k. (c) use the mini-competition process described in paragraph below where Radius Housing determines that the complexity and specialist nature of the services required is anticipated to be less than PS250k. (d) use the direct award on a rotational basis process where Radius Housing identifies that multiple Lot 1 projects arise concurrently or within a similar timeframe, each with a pre-tender construction estimate of less than PS250,000 excluding VAT, Radius Housing reserves the right, at its sole discretion, to apply a rotational direct award mechanism among the highest-ranked Appointed Tenderers as described in the paragraph. Order of Preference 4 Where the Preferred Lot Tenderer is not in a position to perform or accept a Call-Off Contract, Radius Housing (acting at its discretion, but within the confines of the Regulations and Guidance) reserves the right to use (or not) the mini-competition process as noted below. MINI-COMPETITION (WORKS VALUE OVER PS250K OR SPECIALIST NATURE) 5 It is envisaged that Call of Contracts valued by Radius Housing above PS250K will be awarded by way of mini-competition. However, Radius Housing (acting at its discretion, but within the confines of the Regulations and Guidance) reserves the right to use (or not) the mini-competition process. 6 Radius Housing may hold a Mini-Competition to invite and appoint a Tenderer to a Call-Off Agreement. A Mini-Competition shall be open to all Lot 1 Tenderers appointed to the Framework . A mini-competition invitation shall include the precise award criteria which will be used to evaluate mini-tenders submitted by Tenderers. This may be Price only or a Price/Quantity evaluation. 7. When a mini competition is applied to Lot 1, then tenderers will have the opportunity to improve on their original tendered lump sums and percentage adjustments. Tenderers however are not permitted to increase their original tendered lump sums of percentages. DIRECT AWARD ON A ROTATIONAL BASIS 8 Following the award of the Framework work and when Radius Housing determine at its sole discretion, to apply a rotational direct award mechanism among the three (3) highest-ranked Appointed Tenderers. 9 Under this mechanism, Radius Housing may allocate such projects sequentially to the top three (3) ranked Tenderers (e.g., first to third place) in order of their final Lot 1 evaluation ranking, ensuring that where three or more similar projects exist (such as kitchen or bathroom replacement projects), these may be directly awarded to the top three Tenderers respectively, rather than solely to the Preferred Tenderer. 10 This rotational allocation will only be applied where Radius Housing considers it operationally advantageous, necessary for programme delivery, or appropriate to maintain competitive balance and capacity across the Framework. For the avoidance of doubt, Radius Housing shall retain absolute discretion to choose between direct award, rotational allocation, or mini-competition for any project under PS250,000, in accordance with the procurement principles and the requirements of the Framework Agreement LOT 2 AWARD PROCEDURE 1 If Radius Housing decides to source the Services through the Framework Agreement it will award its Services Requirements in accordance with this procedure and the requirements of the Regulations and the Guidance via a Call of Contract. 2 Subject to the provisions of the Framework Agreement, the selection procedure that Radius Housing will use to determine which Tenderer will enter into any Call-Off Contract for its Services Requirements, as set out in a Statement of Requirements (a \"Call Off Contract\") is detailed below. Miscellaneous (Applicable to Both Lots) 1 Notwithstanding the fact that Radius Housing has followed a procedure as set out in this Schedule Radius Housing shall be entitled at all times and for any reason to decline to make an award. Nothing in this Framework Agreement shall oblige Radius Housing to place any Call-Off Contract. 2 Subject to the provisions of this Schedule, Radius Housing may issue a Call off Contract with the Contractor by serving an order in writing in substantially the form set out in Section 12.00. 3 Radius Housing in issuing a Call off Contract pursuant to the above paragraph shall enter a Call-Off Contract with the Contractor for the provision of Services. A Call-Off Contract shall be effective from the commencement date that is specified in the Call-Off Contract."
