This direct award relies upon the justification at paragraph 5 of schedule 5 to the Procurement Act 2023 due to Horstman Defence Systems being the original equipment designer and manufacturer of the Terrier suspension components, CR2 Gas Charging Kit and the Portable Universal Nitrogen Charging Kit (PUNCK).and are the only supplier that can supply the services required. Furthermore paragraph 6 of schedule 5 is relied upon due to there being an absence of competition as Horstman Defence Systems possess the technical know-how and data necessary to perform the requirement without introducing an unacceptable level of risk to operational safety and MOD operational requirements.
