Notice Description

The Council requires a supplier to deliver on the following: * The design and supply of seasonal schemes (Summer and Winter) for a range of locations/planter types. Including hanging baskets, troughs and roundabouts. * The installation and timely delivery across the Town for the floral displays. * The full maintenance of the floral displays, including watering, feeding and deadheading. * Sustainability, with commitments to peat-free compost and pollinator friendly planting. The successful tender was PS287,809.15 excluding VAT over the three year term of this contract.

Lot 1

Options: The contract includes the ability for the Customer to request changes to the scope or delivery of the Services during the contract term. Such changes may relate to the design or nature of the Floral Displays, the Services delivered, associated costs, delivery timelines or other contractual provisions. Any change will only take effect once a formal Change Order has been prepared and signed by both parties. All changes will comply with Section 74 of the Procurement Act 2023 concerning permitted contract modifications. Where the Customer requests a change, the Supplier will prepare a draft Change Order within ten business days, outlining the impact on services, deliverables, costs and timelines. The Customer may then approve or reject the proposed Change Order. If not agreed, the matter may be escalated through the contract's dispute resolution procedure. The Supplier is not entitled to charge for preparing Change Orders requested by the Customer. In addition, the contract includes a permitted modification for variable quantities of hanging baskets required for local business uptake. This adjustment does not require a Change Order and will be managed in line with the provisions set out in Schedule 1.
