Summary of the contracting process

Scotland Excel procured secure accommodation and care services for children and young people whose liberty must be restricted in residential care. The service is for provision across Scotland, at various locations. The requirement is for secure care providers operating accommodation specifically for this purpose, rather than general children’s welfare services. The procurement was managed by Scotland Excel, a central purchasing organisation. A credible provider needs Scottish Ministers’ approval for premises used to restrict children’s liberty, registration with the Registrar of Independent Schools, and Care Inspectorate registration as a secure accommodation service. Staff must hold relevant Scottish professional registrations and be vetted under the Protection of Vulnerable Groups (Scotland) Act 2007. Providers also need suitable insurance and to demonstrate adequate economic and financial capacity. This exercise relates to the use of the negotiated procedure with identified providers of secure accommodation for children and young people in Scotland who hold the necessary authorisations or memberships required in Law (as detailed in III.2). Notwithstanding that Regulation 75(2) of the Public Contracts (Scotland) Regulations 2015 (the "Regulations") applies to this exercise, Scotland Excel has elected, voluntarily, to place this notice for reasons of transparency. The negotiated procedure has been developed in accordance with Regulation 76(8) of the Regulations.
