Summary of the contracting process

Scotland Excel is establishing a flexible framework for fostering and continuing care services, for use by its 32 local authority members and other eligible public bodies in Scotland. The services are intended to help authorities secure nurturing family homes for care-experienced children and young people. There are two service options: standard fostering and continuing care for children whose needs can be met in a stable family setting with routine support; and enhanced placements for those needing additional health, emotional or psychological support, provided through greater carer skill and professional expertise. Services are delivered at various locations across participating councils in Scotland. This is a social work and related services requirement.

Scotland Excel invited tenders through an open procedure to establish a flexible framework. The published submission deadline was 18 November 2026 at 12:00 UTC; an amendment subsequently changed it to 19 November 2026 at 12:00 UTC. The contract period is 2,160 days. The estimated value is £244.95 million for the standard service option and £100.05 million for enhanced services. Suppliers may be appointed to no more than two service options. Evaluation for the standard option weights quality at 80% and price at 20%; the enhanced option’s evaluation approach is set out in the procurement documents. The framework may admit new providers and allow existing providers to vary their service offering, subject to its terms. Authorities have discretion over electronic ordering, invoicing and payment.

This framework is suited to providers able to deliver family-based fostering and continuing care across participating Scottish council areas. Bidders must hold and maintain the regulatory registrations required by law for their offered services, including Care Inspectorate registration where applicable. They must also meet the stated financial-stability and insurance requirements: public liability, employers’ liability, statutory third-party motor vehicle liability and professional indemnity. The bidder must meet these requirements using its own capacity and cannot rely on another organisation to satisfy this selection requirement. Tenderers must provide the names and qualifications of staff assigned to the work. Providers seeking the enhanced option need the carer skills and professional expertise to support children with additional health, emotional or psychological needs. Subcontracting is not permitted for any service requiring the provider to hold regulatory registration. Community benefit commitments are required.

As further detailed in the procurement documents Service Option 1 - Standard Service pertains to the provision of Fostering and Continuing Care Services for children and young people whose needs can be met within a stable family setting with routine support. The anticipated value is estimated and may be subject to change. There is no guarantee of any business, use, level of use or continuity of business through the Flexible Framework. The Award Criteria is Quality/Weighting 80 Price/Weighting 20. Additional information: Economic operators may be excluded from this competition if they are in any of the situations referred to in Regulation 58 of the Regulations. Enhanced Services

As further detailed in the procurement documents Service Option 2 "Enhanced Service" pertains to the provision of Fostering and Continuing Care Services where foster placements support children and young people who have been assessed as requiring additional health, emotional or psychological related support through increased level of carer skill and professional expertise. The anticipated value is estimated and may be subject to change. There is no guarantee of any business, use, level of use or continuity of business through the Flexible Framework. Additional information: Economic operators may be excluded from this competition if they are in any of the situations referred to in Regulation 58 of the Regulations.
