This contract will provide the requirements for Employability Support Services in Scotland. The scheme will be known as 'Work First Scotland' (WFS). The Scottish Government will require the Service Provider to deliver the services as part of the devolution of contracted employment support, on an interim basis in 2017-2018. Namely, it will provide specialist support for disabled people in the workplace and those not already in work, through working with employers, government, schools, colleges and other statutory referral organisations. The aim is to provide a tailored, coherent range of support which can respond flexibly to the individual needs of disabled people and their employers and make best use of resources. The WFS programme will deliver high quality employment support to disabled people with complex issues who want to work and need help to enter and/or remain in the labour market.

Procurement Information

This Contract falls within the category of contracts covered by Regulation 74 of The Public Contracts (Scotland) Regulations 2015 and is being awarded in accordance with the process set out in Regulation 33, in particular Regulation 33 (1) section (c): "reasons of extreme urgency brought about by events unforeseen by the contracting authority, the time limits for open procedure, restricted procedure or competitive procedure with negotiation cannot be applied". This is due to the fact that new powers to provide employment support for disabled people and those at risk of long term unemployment are being devolved from the UK administration to Scotland under the Scotland Act 2016, creating an urgent need to ensure appropriate interim arrangements. A PIN is in place for full procurement of the services on a long-term basis, Ref 465635 - OJEU Ref:2016/S 203-366776 published 20 Oct 16.

        "reviewDetails": "The notification will incorporate a 'standstill period' of a minimum of 10 clear calendar days (or a minimum of 15 if the communication method used is not electronic) between the date on which the Authority despatches the VEAT notice and the date on which the Authority proposes to conclude the relevant Contract. The bringing of court proceedings against the Authority during the standstill period will automatically continue the prohibition on entering into the Contract until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the Contract has been entered into include the setting aside of the decision to award the Contract to the winning tenderer. The bringing of court proceedings against the Authority after the Contract has been entered into will not affect the Contract unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise the remedies that may be awarded by the courts where the Contract has been entered into are limited to the award of damages."
