Lot Information

Lot 1

The required modification will increase the Contract value by up to 50% of the original value to allow a previous contractual provision to be used. Zero Waste Scotland does not currently anticipate or intend to spend the full modified Contract value, which shall be determined as required on an annual and case-by-case basis. The modification allows a provision in the original Contract to be exercised - namely, the extension of the Contract to provide annual maintenance and technical support. There are no other changes to the scope of services required or the duration of the original Contract, including the optional extension periods.

Renewal: This contract may be extended by up to a further three 12-month periods to retain annual maintenance and support, subject to continued demand and funding.

These were linked to external policy development and included services contracted separately for the development of an application programming interface (API) that could not be delivered as intended and which was transferred to exeGesIS under the scope of this Contract. While an attempt was made to futureproof the original Contract, the timing and scale of the requirements were unforeseen. The scope of the Contract could accommodate these developments, however the timing and the scale of the work required had not been anticipated and therefore the value of the Contract was used more rapidly than expected. This meant there was little residual value left to allow optional extension periods provided within the Contract to be exercised, for annual maintenance and technical support. The modification is permissible under Article 72(1)(b) of Directive 2014/24/EU on public procurement, and regulation 72(1)(b) of the Public Contracts (Scotland) Regulations 2015.",
"rationale": "Need for additional works, services or supplies by the original contractor/concessionaire: The modification allows a provision in the original Contract to be exercised - namely, the extension of the Contract to provide annual maintenance and technical support. There are no other changes to the scope of services required or the duration of the original Contract, including the optional extension periods. Zero Waste Scotland has not contributed to or caused the need for this modification. It is considered that re-tendering for this service at this time would incur significant additional cost to Zero Waste Scotland, both during the procurement procedure and potential transition to a new service provider, which in turn would be disruptive in terms of the overall provision of the Litter Monitoring Software. This modification would not have resulted in a different outcome during the procurement procedure and has not disadvantaged any other potential supplier."
