The Operator shall ensure that all vehicle used under any Contract Awarded under this Framework Agreement shall fully comply with all requirements of law relating to passenger carrying vehicles including licencing, insurance, testing, operation, construction and use regulations, fitness, equipment, safety, maintenance and use of CCTV equipment. 2. The Operator shall ensure that all the appropriate certificates, licences and any specific training requirements are at all times in full force and effect and stated in Schedule 2 Conditions of Contract. 3. It is our understanding that the Terms of the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) might apply in the event of this Contract being awarded to a tenderer other than the current service provider. Each tenderer must satisfy itself as to whether or not in its view the TUPE regulations will apply and tenderers are advised to seek independent professional advice on the consequences for them if they are the successful tenderer and the TUPE regulations are held to be applicable. 4. Successful Operators will be required to provide Management. Information and KPIs on a quarterly basis including the reporting on Community Benefits provided. 5. A minimum score of 2 out of 4 is required. Full details of the scoring is provided in the Invitation to Tender document. 6. It is a mandatory requirement for each bidder (or any of its subcontractors) to fully comply with the Data Protection Act. 7. Tenderers are advised to allow adequate time for uploading documents and to dispatch the electronic well in advance of the closing time to avoid any last minute problems. (SC Ref:531919)",
