The Scottish Legal Complaints Commission (SLCC) wishes to appoint up to 3 legal firms to operate under a Framework Agreement for the provision of cost effective, responsive, flexible and high quality legal services.

Lot 1

Litigation The SLCC are looking for a full legal service, although, the main areas for legal support (but not limited to) are in relation to appeals against determinations and, in the rare case of judicial review of decisions. This will include, pre-litigation advice in relation to prospects and legal process, drafting of submissions and advocacy as well as the instruction of Counsel or solicitor advocates as necessary (we require firms to be able to offer both options). The provision of opinions in relation to appeals, the eligibility and handling of complaints, time bar, and merit of complaints are also matters requiring legal advice. Geographical cost efficiency On account that jurisdiction for disputed matters sits with the inner house of the Court of Session and since the SLCC have only a single office in Edinburgh, a responsive litigation service within Edinburgh is sought to maximise cost efficiency and to restrict travel, expenses or meeting costs being incurred by the SLCC. The SLCC Providers will require to advise and assist the SLCC in proportionately managing risk by advising on the SLCC's regulatory and statutory powers and functions as well as its governance arrangements. General legal advice in relation to the interpretation and application of the Legal Profession and Legal (Aid) (Scotland) Act 2007, the Legal Services (Scotland) Act 2010 and an advisory role in relation to relevant policy matters such as the complaints levy and function of the SLCC is also required. The regulation of legal services in Scotland is currently under review, and input may be required to assist new rule drafting or to comment on draft Regulations or Bills. General Legal Advice Access to a full service legal including, but not limited to, employment law, property law and leasing, debt recovery, court rules, data protection, GDPR, FOI, law firm or partnership administration and adhoc general legal updates will be required. On occasion expert advice on specialist legal issues may be sought. From time to time advice is needed on areas of law leading to complaints, to assist assessment of a transaction underlying a service complaint to the SLCC. Common areas are residential conveyancing, civil litigation, criminal, family, trust and executry. Training and Development The Firms appointed will also be required to provide training and development opportunities for the SLCC. Service Delivery The SLCC is an organisation which requires fast access to advisors for clear, accurate and unambiguous legal advice which also consider risk, proportionality of response, and reputation. SLCC are seeking access to an advisory helpline and are looking for legal providers who have the ability to discuss legal and policy matters informally as well as be able to provide urgent advice or formal written opinions in clear, succinct English without jargon.
