NHS NSS & NES eRostering System Contract
Notice Description
NHS National Services Scotland (NSS) working with NHS Education for Scotland (NES) are procuring a Contract for a single eRostering System across the NHS in Scotland. NHSScotland (NHSS) published a new Digital Strategy for Health and Social Care in April 2018. This strategy sets out a commitment to build a national approach to the use of digital technologies. The workforce of NHSS is our most valuable resource. We need to ensure that we deploy that workforce in a way that most effectively meets the needs of patients; we need to ensure that our staff have access to information about their working patterns that enable them to manage their working lives, including accessing additional shifts in an easy and intuitive way; we need our rostering systems to be capable of operating across traditional NHSBoard boundaries. Using the ESPD process we will shortlist a number of Bidders to receive the ITT. Please respond by completing the ESPD.

Lot 1
The Authority NHS NSS and NHS Nes on behalf of NHSScotland seeks to procure a new national eRostering solution and replace the existing disparate arrangements in place across the various NHS Boards. It requires the system to be capable of interfacing with other relevant NHSScotland business systems to allow automated import and export of data to and from these. The services to be provided within the scope of the contract are: A single eRostering solution and associated business model for NHSScotland, with localised management and delivery of the eRostering services across individual Health Boards, sites and units. System hosting, maintenance and development Data migration from existing disparate Board systems to the single solution User training and skills transfer - during implementation and ongoing throughout the term of the contract Using the ESPD process we will shortlist a number of Bidders to receive the ITT. Please respond by completing the ESPD.
Options: The ITT documents will describe possible future functionality that may be required at a later date.
Renewal: The initial 7 years may be extended to 10 years with each additional year after 7 being optional

"reviewDetails": "The authority will notify economic operators who submitted a tender or (where no deselection notification has previously been made) applied to be selected to tender, of its decision to award the contract which notification will contain among other information, a summary of the reasons why the economic operator was unsuccessful. The notification will incorporate a 'standstill period' of a minimum of 10 clear calendar days (or a minimum of 15 if the communication method used is not electronic) between the date on which the authority despatches the notice(s) and the date on which the authority proposes to conclude the relevant contract. The bringing of court proceedings against the authority during the standstill period will automatically continue the prohibition on entering into the contract until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the contract has been entered into include the setting aside of the decision to award the contract to the winning tenderer(s). The bringing of court proceedings against the authority after the contract has been entered into will not affect the contract unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established. Otherwise the remedies that may be awarded by the courts where the contract has been entered into are limited to the award of damages. Economic operators are entitled to write to the authority after receipt of the notification should they require further clarification. The authority will respond within 15 days of such a written request, but it should be noted that receipt by the authority of such request during the standstill period may not prevent the authority from awarding the contract following the expiry of the standstill period. Economic operators should approach the contracting authority in the first instance. However, the only formal remedy is to apply to the courts: An economic operator that suffers or is at risk of suffering, loss or damage attributable to a breach of duty under the Public Contracts(Scotland) Regulations 2015 or the Procurement Reform (Scotland) Act 2014, may bring proceedings in the Sheriff Court or the Court of Session."
