Legal Services Providers - Commercial / Litigation / Financial Guardianship & Interveners
Notice Description
South Lanarkshire Council have an on-going requirement to outsource some legal services. The Council has an in-house legal team which will provide the vast majority of legal services, however a requirement exists to outsource work where; 1. The Council is in law unable to carry out the work itself e.g. Financial Guardians, 2. Work of a more specialised nature requiring specific levels of necessary experience is required, 3. Due to levels of high demand, the in-house team lack capacity at the relevant time. . To allow for maximum flexibility, it is proposed that Framework be offered to the market for 3 years with a possible extension of 24 months. The Framework will be split into 3 Lots; with 1 bidder awarded to each of Lots 1 and 2, and maximum 4 bidders awarded to Lot 3. . Bidders are invited to bid for 1, 2 or all Lots as they see fit.
Lot Information
Edinburgh Agent and Complex or High Value Litigation Work
The Council are seeking to appoint one legal provider who will act as Edinburgh agent for the Council and provide advice and assistance in complex or high value litigation related work. This can involve but is not restricted to: Lodging of Caveats; Judicial Review; Court of Session actions; Arbitration & Adjudication; Sheriff Court actions.
Renewal: Optional extension for 24 months.
Financial Guardianship and Intervention OrdersThe Council are seeking to appoint a maximum of four legal firms who can demonstrate experience in the following areas: Acting as a Financial Guardian and acting as a Financial Intervener, both in terms of the Adults with Incapacity (Scotland) Act 2000.
Renewal: Optional extension for 24 months.
Commercial and Other WorkThe Council are seeking to appoint one legal provider who is able to deliver a range of advice and assistance on matters within the remit of local authorities (excluding that in Lot 2). This is anticipated to be mainly in relation but not restricted to: Commercial Conveyancing; Commercial Contract; Procurement; Planning & Environmental. Excluding Employment law which is the subject of a separate agreement. . The council are also looking for the successful tenderer to be willing to provide training to Council staff in relation to the areas of work in this Lot.
