Notice Description
Framework Agreement for the provision of Care Homes for Adults with Learning Disabilities Including Autism. The scope of services to be provided is relative to the provision of social and other specific services as defined in Schedule 3 of the Public Contracts (Scotland) Regulations 2015 ("the Regulations") and in accordance with Regulations 74-76. This procurement is designed to admit new entrants/new services as set out in "19-18 New Entrants", found in the attachment area of the ITT. At designated time throughout the Duration, New Entrants may apply to be included, following completion of the a qualification no more onerous than the original tender, and existing Providers may apply to include New Services following an abbreviated evaluation process.

Framework for accommodation, care and support services in Care Homes for Adults with Learning Disabilities Including Autism for Scottish Local Authorities and/or any Integration Authorities, or other bodies established pursuant to the Public Bodies (Joint Working)(Scotland) Act 2014 with powers to purchase such services. Scotland Excel elects to use the ESPD in this exercise in respect of exclusion grounds and selection criteria for these contracts, as a matter of best practice. Economic operators may be excluded from this competition if they are in any of the situations referred to in Regulation 58 of the Public Contracts (Scotland) Regulations 2015. FINANCIAL STABILITY Scotland Excel will conduct a financial analysis on bidders from a credit referencing agency. The bidder is to confirm that a search will not return a \"Warning\" or \"caution\" returnable code or any neutral code, or can provide documents to prove that the bidder does/would not represent an unmanageable risk should it be appointed onto the proposed framework agreement. Bidders who are unable to demonstrate satisfactory financial stability will be excluded. MINIMUM INSURANCE REQUIREMENTS: The Provider will insure, and maintain insurance, for the Duration the following minimum insurance and indemnity requirements: i. Public and Products Liability to a minimum indemnity limit of 20 million GBP each and every claim. Liability must not exclude abuse and/or molestation cover. ii. Medical Malpractice Liability - where applicable, a Policy or an extension to Public Liability cover to a minimum indemnity limit of 10 million GBP any one incident and in the aggregate; iii. Employers Liability - where required, to a minimum indemnity limit of 10 million GBP each and every claim. Where the Provider is exempt from this requirement, e.g. as a 'sole trader', then this must be confirmed by the Provider in writing; iv. Professional indemnity - where a provider is employing any Staff who are professionally qualified, to a minimum indemnity of 2 million GBP any one incident and in the aggregate and where in the aggregate, a minimum of one automatic reinstatement of the limit in any one period of insurance. v. Statutory Third-Party Motor Vehicle Liability - where a vehicle is used in delivery of the Service, statutory third party motor vehicle liability insurance to a minimum indemnity limit of 5 million GBP for property damage and unlimited for third party injury or ongoing arrangements in place to ensure that Staff using their private vehicles are appropriately insured for business purposes. Notwithstanding the above, the Purchaser may request an increase in the minimum level of insurance cover required The buyer is using PCS-Tender to conduct this ITT exercise.
