ESPD (Scotland) Question 4B 5: Insurance Requirements It is a requirement of this contract that bidders hold, or can commit to obtain prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below: ESPD (Scotland) Question 4B.5.1b Employers' Liability - in accordance with Regulation 5 of the Employers' Liability (Compulsory Insurance) Regulations 1998 to a minimum indemnity limit of Five million pounds (5,000,000 GBP) Sterling each and every occurrence; Public/Products Liability - to a minimum indemnity limit of Five million pounds (5,000, 000 GBP) Sterling each and every occurrence and in the aggregate in respect of Products; and Third party Motor Vehicle insurance - in accordance with the provisions of the current Road Traffic Act 1988 to a minimum indemnity limit in respect of third party property damage of Five million pounds (5,000,000 GBP) Sterling each and every occurrence, but unlimited in respect of bodily injury. Goods in transit insurance - goods in transit insurance, for the full contract/order value for each and every load/delivery. Notwithstanding the minimum insurance requirements to participate in the Framework Contract as detailed within the tender documents, due to the nature of some of the items available for purchase through the scope of this framework, the Council may decide to increase the minimum insurance requirements at Call-off stage. This will be dependent on the products required and the intended use assessed by individual Councils on a case by case basis. The Contractor will be provided with the opportunity to arrange to increase its insurance cover to the level stipulated by the Council and to reflect the increased cost (if any) to take part in such Call offs. For bidders who will sub contract parts of the business, the bidder will provide a letter signed by a person of appropriate authority confirming that the bidder has ongoing arrangements in place to ensure that sub-contractors are appropriately insured. 2.
