The University of Aberdeen considers the use of the negotiated procedure without prior publication of a contract notice in terms of Regulations 33(1)(b)(iii) of the Public Contracts (Scotland) Regulations 2015 is justified because of absences of competition for technical reasons - i.e the bespoke subsea acoustic modem system required for the project is not available from any other company to the required specification in addition to the fact that no other company has the technical expertise and detailed understanding of the system.
