All the exclusion grounds will be dealt with on a PASS/FAIL basis. In respect of the mandatory exclusion grounds your bid will be excluded where you fail to provide either a positive response or to provide details to the satisfaction of SPT of the self-cleansing measures you have undertaken to prevent reoccurrence of any failing. In respect of the discretionary exclusion grounds your bid may be excluded where you fail to provide either a positive response or if SPT is not satisfied as to the self cleansing measures undertaken. DUNS RATING:SPT will use Dun and Bradstreet's DBAi financial reporting system to assess the financial stability of bidders. Bidders with a Failure Score of 51 or above on the DBAi system will be deemed to have evidenced satisfactory financial stability. Bidders must confirm within their response to the relevant question within the Qualification Envelope, the value of their D&B Failure Score. In the event that the bidder does not have a Dun and Bradstreet rating or they consider that the rating has been adversely affected by factors which they can offer mitigating evidence for, we will use the following ratios to evaluate a bidder's financial status. Bidders must confirm within their response to the relevant question within the Qualification Envelope, the name and value of the 3 financial ratios listed in the tender documents as taken from their own Accounts. 1 Profitability - this is taken as profit after tax but before dividends and minority interests. If a company makes a profit then it is a pass for this ratio; 2 Liquidity - this value is calculated as current assets less stock and work in progress, divided by current liabilities. If the answer is greater than or equal to one then it is a pass for this ratio; 3 Gearing - this value is calculated as the total external secured borrowing (short term and long term) divided by shareholder funds expressed as a percentage. If the answer is less than or equal to 100% it is considered a pass for this ratio. Where 2 out of the 3 ratios cannot be met, we may then take account of other factors (including those listed below) when assessing financial viability and the risk to the organisation, providing that the Bidder can submit acceptable evidence to substantiate any of the mitigating criteria as listed in the tender documents Please note that a Failure Score below 51 or where SPT have reviewed your accounts and any supporting evidence and have deemed your organisation to be at a high risk of failure, your submission will be considered as having not met the required criteria, will be dismissed and not taken forward for further evaluation. INSURANCE REQUIREMENT failure of the Consultant to use the skill and care normally used by professionals providing services similar to the Services GBP5,000,000 in respect of each claim, without limit to the number of claims for 12 years death or bodily injury to a person (not an employee of the Consultant) or loss of or damage to property resulting from an action or failure to take action by the Consultant GBP10,000,000 in respect of each claim, without limit to the number of claims for 12 years death or bodily injury to an employee of the Consultant arising out of and in the course of their employment in connection with this contract GBP10,000,000 in respect of each claim, without limit to the number of claims 12 years The Consultant's total liability to the Employer for all matters arising under or in connection to this contract, other than excluded matters, is limited to GBP5,000,000 (five million pounds only).Loss or damage to third party property does not form part of the excluded matters in this clause."
