Notice Description

The City of Edinburgh Council (the "Council") requires a Concession Contract for events held at the Ross Bandstand and West Princes Street Gardens. A ticketed 2-day Community and Family orientated event utilising both the Ross Bandstand and West Princes Street Gardens. Maximum 12 days including ingress and egress on site. Please refer to Lot 1 Specification for details in full.. This tender will focus only on large or major events (an event involving large tents or infrastructure which is estimated to attract 1000 or more people would be considered as a 'Large Event'). Please refer to Lot 1 Specification for details in full.

Renewal: It is the intention of the Council that any Contract resulting from this ITT will commence March 2026 for a period of two years with two optional 12-month extensions (2 + 1 + 1), undertaken at the sole discretion of the Council.

Summer Festival at Ross Bandstand

A ticketed venue for either cultural, theatre or performing arts event of up to 44 performance days in total utilising the Ross Bandstand only and accommodating both the established Edinburgh Festival Carnival and Edinburgh International Festival 'large events' as part of the schedule. Events based on a potential 54 days hire period (including build, performance and strike periods). Lot 2 events and activities are restricted solely to using the Ross Bandstand and its footprint with no large infrastructure permitted in the wider Gardens. Please refer to Lot 2 Specification for details in full.. This tender will focus only on large or major events (an event involving large tents or infrastructure which is estimated to attract 1000 or more people would be considered as a 'Large Event'). Part IV: Selection criteria - B: Economic and financial standing - Question 4B.4 - Tenderers will be required provide the following information in response to 4B.4: Lot 1 May Event Current ratio for Current Year: 1.10 Current ratio for Prior Year: 1.10 Lot 2 Summer Festival at Ross Bandstand Current ratio for Current Year: 1.10 Current ratio for Prior Year: 1.10 Lot 3 September Event Current ratio for Current Year: 1.10 Current ratio for Prior Year: 1.10 The formula for calculating a Tenderer's current ratio is current assets divided by current liabilities. The acceptable range for each financial ratio is greater than the requested current ratio. Where a Tenderer's current ratio is less than the acceptable value, the Council may exclude the Tenderer from the competition or may apply discretion seeking supporting evidence to determine the Tenderer's suitability to proceed in the competition. Part IV: Selection criteria - B: Economic and financial standing - Question 4B.5 - Tenderers are required to hold, or commit to obtaining prior to the commencement of any subsequently awarded contract, the types and levels of insurance indicated below: a. Employers (Compulsory) Liability Insurance - GBP 5m b. Public Liability Insurance - GBP 10m c. Events Insurance - GBP 5m Where a Tenderer does not hold or commit to obtaining the types and levels of insurance indicated, the Council will exclude the Tenderer from the competition."

Tenderers should confirm that this condition will be met within the response to this question Part IV: Selection criteria - C: Technical and Professional Ability - Living Wage Payment - Question 4C.5 - It is a mandatory requirement that Tenderers confirm that they will pay staff that are involved in the delivery of the Contract, (including any agency or sub-contractor staff) directly involved in the delivery of the Contract, at least the Real Living Wage. Tenderers should confirm that this condition has been met within the response to this question. Part IV: Selection criteria - C: Environmental Management Measures - Question 4C.7 - Tenderers will be required to provide evidence that their organisation has taken steps to build their awareness of the climate change emergency and how they will respond. Accepted evidence includes but is not limited to: A completed copy of \"Appendix F Climate Change Plan\" including planned projects and actions to reduce the Tenderer's carbon emissions. This does not need to contain calculated carbon emissions. Please note Appendix F is supplied as an individual document for completion. Where a Tenderer's response is of a less than the acceptable standard, the Council may exclude the Tenderer from the competition or may apply discretion seeking supporting evidence to determine the Tenderer's suitability to proceed in the competition. Part IV: Selection criteria - D: Health and Safety - Question 4D.1 - It is a mandatory requirement that Tendering Organisations with more than 5 employees have in place a Health & Safety Policy which is approved at a senior level within the Organisation and is reviewed regularly. Tenderers should confirm that this condition has been met within the response to this question. Where a Tenderer does not have a Health & Safety Policy and is required to do so, the Council may exclude the Tenderer from the competition."

        "reviewDetails": "A tenderer that suffers loss as a result of a breach of duty under the Public Contracts (Scotland) Regulations 2015 may bring proceedings in the Sheriff Court or the Court of Session. The City of Edinburgh Council (the Council) will have a minimum standstill period of 10 days before awarding the contract. The communication of the award decision notice will be sent by fax or e-mail to all tenderers with the standstill period commencing on the next day. If proceedings are started in the Sheriff Court or the Court of Session against the Council in respect of the decision to award the contract within the standstill period then the Council is prevented from awarding the contract. Post contract award the Sheriff Court or the Court of Session may (1) award damages provided proceedings are brought within 3 months from the date when the grounds for the bringing of the proceedings first arose (2) be entitled to issue an ineffectiveness order or impose a financial penalty on the Council.
