If any contract documents are accompanied by instructions on safeguarding classified information (e.g. a Security Aspects Letter), the Authority reserves the right to amend the terms of these instructions to reflect any changes in national law or government policy, whether in respect of the applicable protective marking scheme, specific protective markings given, the aspects to which any protective marking applies, or otherwise. The link below to the Gov.uk website provides information on the Government Security Classification. https://www.gov.uk/government/publications/government-security-classifications Electronic Trading. Potential suppliers must note the mandatory requirement for electronic trading currently via email invoicing, with Babcock DSG Limited. The Cyber risk level is low and the Risk Assessment Reference RAR code is RAR-9CDU6MD2. All Potential Operators who are invited to tender must complete the Supplier Assurance Questionnaire (SAQ) via the Supplier Cyber Protection Service (Octavian) https://supplier-cyber-protection.service.gov.uk/ to demonstrate their compliance with the required cyber risk level. This is a self-assurance process and no validation of the SAQ return is required. Advertising Regime OJEU:- This contract opportunity is published in the Official Journal of the European Union (OJEU),the MoD Defence Contracts Bulletin and www.contracts.mod.uk Justification For Non-Competitive Decision: It is considered this requirement can be placed using the negotiated procedure without prior publication pursuant to Article 25(1)(a) of Directive 2009/81/EC (Regulation 16(1)(a)(i) of the Defence and Security Public Contracts Regulations 2011) due to the absence of suitable tenders in response to the previous restricted procedure reference 2019/S 146-360833. In respect of the previous restricted procedure, the UK Ministry of Defence received a single tender response and that tender was evaluated as being commercially non-compliant. Optical instruments. Babcock DSG Limited, which is acting as the agent for the UK Ministry of Defence known as the Authority, is considering a Framework Agreement to Supply spares and associated items for the C2A2 Sight Unit.
