It is considered that the Contract can be awarded to the Supplier using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(3)(b) of Directive 2014/24/EU (Regulation 32(5)(b) of the Public Contracts Regulations 2015 (SI 102)) in respect of additional deliveries by the Supplier. The Supplier is the original manufacturer of existing equipment and a change of supplier would oblige the DSTL to acquire supplies having different technical characteristics which would result in incompati!bility or disproportionate technical difficulties in operation and maintenance.
