Regulation 72 of the Public Contracts Regulations 2015 allows for modification of the contract during its term, providing certain criteria is satisfied. The modification is justified as follows i) the full impact of the Covid-19 pandemic and the resulting response required to manage this could not have been foreseen, and; emerging national policy and legislative changes have been introduced within this period and were not able to be assessed through an Options Appraisal prior to now due to the national timeframe for planning and implementation; ii) the modification will not alter the overall nature of the contract; iii) there will be no increase in contract value, with the contract remaining at the same annual value. This was a procurement for services specified in Part B of Schedule 3 of the Public Contracts Regulations 2006 (?Part B services?). Accordingly the Public Contracts Regulations 2006 (as amended) only applied in part. The procurement exercise was conducted in accordance with the information contained in the contract documents.
