The term of this contract was 5 years with an option to extend a further 4 years subject to further market testing evidencing no viable competition after the first 5 years of the contract. Direct award in accordance with the criteria outlined in Regulation (32) (a) of the Public Contract Regulations (PCR) (2015) (as amended). This contracted was award in line with the service specification and NHS (PDS) contract terms and conditions.

Following market engagement, it was evident that there was not enough competition to justify a competition process therefore approval for a direct award in accordance with the PCR 2015 (as amended), Regulation (32) - Use of the negotiated Procedure without Prior Competition (2) 'the negotiated procedure without prior publication may be used for public works contracts, public supply contracts and public service contracts in any of the following cases' (a) 'where no tenders, no suitable tenders, no request to participate or no suitable requests to participate have been submitted in response to an open procedure or a restricted procedure, provided that the initial conditions of the contract are not subsequently altered', 'has been complied with in the award of these contracts'.
