Summary of the contracting process

The Ministry of Defence in the UK is seeking procurement for a seven-month extension of the DevNUSCOT training simulators under a limited tender process. This contract, valued at £451,108 and effective from 5th November 2021, falls within the goods category, specifically related to military training equipment. The procurement method was a negotiated procedure without publication of a contract notice due to the technical nature of the goods, with Thales UK Ltd being the sole supplier capable of fulfilling the contract requirements, given their exclusive access to the necessary source code and know-how.

This tender presents growth opportunities primarily for businesses specialising in training simulators, military equipment, and defence technology. As the contract has been awarded without competitive tendering, potential suppliers in related fields who possess relevant expertise and capabilities may consider approaching the Ministry of Defence for future collaborations or discussions. This procurement is particularly advantageous for companies capable of providing innovative solutions or technological support, aligning with the Ministry's needs for advanced training tools.

Procurement Information

In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 due to technical reasons. This is because Thales are the original equipment manufacturer (OEM) and the Design Organisation for the support in question and are the only economic operator with access to the source code and know how necessary to perform this requirement.
