    "description": "Council Executive Procurement Approval Report is provided below : Real Life Options are contracted to provide day care provision at An Carina Day Centre and provide a high standard of supported day time opportunities, personal care and transport to 12 adults with an assessed learning disability, all of whom have critical or substantial needs. The review of internal and external day care provision has been delayed until 2022/23 due to the impact of COVID 19. Pending the conclusion of the review it is, important to maintain the current provision to ensure stability of the available provision as well as continuity of care for both existing and potential clients to enable the review to take place and inform the strategic direction, commissioning and procurement decisions, for both internal and external day care provision in the future. The contract value over the previous year is GBP550,000 and the value of the proposed award is GBP557,820. The aggregated value of GBP1,107,820 is above the Light Touch Regime threshold (GBP663,540). Regulation 33 (1) of the Public Contracts (Scotland) Regulations 2015 allows a contracting authority to make a direct award of a public contract following a negotiated procedure without prior publication where competition is absent for technical reasons. Whilst the Council's Standing Orders permit the Head of Corporate Services to approve the direct award, they may opt to seek approval from Council Executive. Council Executive is, therefore, requested to approve a direct award to Real Life Options for Day Care Provision for a period of 18 months from 01/10/2021 to 31/03/2023, with an estimated value of GBP557,820.
