The services required for annual website hosting and maintenance can only be fulfilled by a specific agency - Simpleview - who have sole access to Visit Birmingham's back end infrastructure and CMS/DMS. Each year we pay Simpleview, our website provider, hosting and maintenance costs for the running of our core leisure tourism channels visitbirmingham.com/meetbirmingham.com and makeitwm.com - this is a service that can solely be done by them, as they alone have access to the IT systems and infrastructure that is required to fulfil this service. West Midlands Growth Company Ltd have directly award the contract to Simpleview due to the nature of the service required and inline with principles set in PPN01/20 where direct award is permissible due absence of competition and protection of exclusive rights under Regulation 32 (2) of the PCR which allows for sole supplier sourcing through use of a negotiated procedure without prior publication to be used and this request also falls within Regulation 32 (5) delivery of services by an existing supplier to where competition is absent due to technical reasons. In the case of this procurement competition is absent and only one supplier can provide the expertise required to produce the product or has capacity to complete on the scale required. The protection of exclusive, including the intellectual property rights, the current supplier owns those rights and has the exclusive right to exploit the intellectual property to the rights and WMGC is seeking to directly award for the services with the nominated contractor.
