Procurement Information

The FsAST PT part of the UK Ministry of Defence, (the "Authority") intends to award a contract to AMST-SYSTEMTECHNIK GMBH for the provision of a comprehensive upgrade to the hardware and software for the two Spatial Disorientation Trainers (SDTs) at RAF Henlow to ensure the continued operation of the SDTs. The contract has an estimated value of PS2,800,000.00 and a proposed term of one year. In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for exclusive rights and technical reasons. This is on the basis that AMST is the Original Equipment Manufacturer (OEM) [and Design Authority (DA)] of the SDTs and has supported the SDTs, both the hardware and software, for the last [15] years. As the OEM [and DA] AMST owns the drawings, data and other required technical information in the SDTs needed to modify and complete the upgrade of the hardware and software. The Authority does not own, nor does it have the right to pass on to third parties, the drawings, data and proprietary information necessary to complete the upgrade to the SDTs. Therefore, any modification within the required safety case cannot be assured unless the upgrade work is carried out by AMST, the OEM. In addition, the Authority does not hold, nor does it have rights to the source code. Any modification required to copyright works will have to be completed by AMST as the OEM.
