Mid and South Essex Mental Health Services
During 2021/22 a Mental Health Taskforce was formed to review the mental health commissioning arrangements in Essex, to identify any gaps in process and make recommendations to improve the commissioning of mental health services across the County. One of the key recommendations was to streamline commissioning and contract management processes, with Accountable Officers making the commitment to a single contractual approach for the incumbent Provider, Essex Partnership University NHS Foundation Trust (EPUT). As a result, the Authority has taken a decision to vary it's existing contract with EPUT for provision of Mental Health Services, from 1st April 2022 , to include the scope of mental health services for NHS North East Essex CCG, NHS Ipswich and East Suffolk CCG and NHS West Suffolk CCG, for the remaining term of two years, until 31st March 2024. NHS Mid Essex CCG on behalf of the Authority, will be the lead commissioner, and NHS North East Essex CCG, NHS Ipswich and East Suffolk CCG and NHS West Suffolk CCG will be associates to the contract, managed via a Collaborative Commissioning Agreement. The scope of additional mental health services being varied into the MSE Contract for Mental Health Services includes; Non-Psychotic Mental Health Care Clusters 1 - 8 Specialist Perinatal Mental Health Community Service Individual Placement and Support Mild Cognitive Impairment Dementia Enhanced Care Home Liaison Service MH ANP GP pilot service - Advanced Nurse Practitioner Adult Community Crisis Resolution and Home Treatment Service Crisis Cafe Covering both Clacton and Tendring Infant MH Intensive Psychology Support Unit Core 24 Mental Health Liaison Service Eating Disorders ADHD Services The Authority may wish to introduce additional services during the remaining term of the contract ("Contract modifications"). Such contract modifications will be contemplated where additional requirements are similar and or complementary to the services already included in the Specification, at any given time. Such expansion would be by the addition of services commissioned by the Authority as named in the Contract Award Notice. To this end, the market should be aware that there is a possibility that the incumbent provider may be offered a variation to the contract to include (but not be limited to) the following list of Services in accordance with Regulation 72 (1) (a) of the Public Contracts Regulations 2015 (as amended The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020). Any such modifications will be accompanied accordingly with appropriate Notice(s). "description": "When the original contract was awarded there was no reference within it to creation of or delivery within an Integrated Care Systems (ICS) as the concept had not been fully developed by NHSE yet. The NHS England current guidance is that where there are multiple commissioners for one provider, their preference is for one contract via collaborative arrangements in line with the establishment of ICSs. As such, these circumstances which have rendered the modification necessary are deemed unforeseen by the Authority. The current MSE contract for Mental Health Services with EPUT has been varied to: i) add North East Essex (NEE)CCG as an additional contracting authority (associate) to the contract, ii) incorporate the Mental Health Services required by NEE CCG iii) add Ipswich and East Suffolk CCG and West Suffolk CCG as an additional contracting authorities (associates) to the contract, and iv) incorporate the Mental Health Services required by Ipswich and East Suffolk CCG and West Suffolk CCG. The Authority deems that such modifications meet the grounds under Regulation 72 (1) (C) that they do not change the overall nature of the contract, for Mental Health Service delivery. - The value of the North East Essex MH services are approx. PS43.519 million per annum - The value of the Ipswich and East Suffolk MH Services are PS912,000 per annum - The value of the West Suffolk MH Services are PS573,000 per annum The aggregated contract value associated with the scope of services above (pertaining to the element of the contract being modified), based on the remaining two years of the existing term is approx. PS90,008,000 million. The total aggregate contract value of the existing mental health service contract over the five year term is PS555,684,000. The proposed modification represents 16.2% of the original contract value and is therefore under the 50% threshold within Regulation 72 (1) (c) of the Public Contract Regulations 2015. The new aggregate value of the contract over the entire duration of it's term, including modifications is therefore PS645,692,000.",

The Authority deems that such modifications meet the grounds under Regulation 72(1)(c) that they do not change the overall nature of the Contract, and represents 16.2% of the original contract value so is under the 50% threshold Regulation 72(1)(c)."
