Summary of the contracting process

The Lisburn and Castlereagh City Council has completed a procurement process for the "Tender For The Collection & Recycling Of Rubble From Council Household Recycling Centres". This contract, which falls under the refuse collection services category, was initiated with a limited procurement method, involving a negotiated process without prior publication. The contract was awarded on 30 June 2022, with a total value of £234,892, focusing on providing essential services for waste collection and recycling in the Lisburn and Castlereagh area. The current contract, active until 11 November 2023, allows for further extensions due to fluctuations in transport and processing costs exacerbated by various economic factors, including increased energy prices and changes in National Insurance contributions.

This tender offers significant growth opportunities for businesses specializing in waste management and recycling services, particularly those with capabilities in handling construction debris such as rubble. Companies equipped to establish efficient logistics for waste collection and recycling are encouraged to engage in future procurement processes as the Council adapts to ongoing economic pressures and seeks value for money. Ideal competitors would include both large-scale waste management providers and innovative small to medium-sized enterprises that can deliver cost-effective and efficient solutions tailored to local council needs.

Lot Information

Lot 1

Contract waste will comprise of rubble, to include ceramic tiles, toilets and basins.

Procurement Information

This relates to the variation of an existing contract. Proposed cost increases to the existing contract are attributable to the on-going increasing costs associated with transport and processing (eg fuel, particularly the move from red to white diesel, energy and staffing) which have been fuelled by not only Brexit and economies restarting following Covid but also the more recent increase in National Insurance costs. The Russia/Ukraine war has also exacerbated fuel and energy costs on a global level. Due to the current uncertainty and volatility around fuel and energy costs an extension of 6 months has been proposed. As the contract exit date will be 11 November 2023 further extensions under the contract are available to the Council. The council are content that the proposed increased rates still represent value for money in terms of the original procurement. It is reasonable to assume that contractors would not have foreseen the current cost increases in delivering services under the contract at time of tendering. This direct award is permitted by Regulation 72(1)(c) of the Public Contracts Regulations 2015 (c) where all of the following conditions are fulfilled:-- (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract; (iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.
