Summary of the contracting process

The Lisburn and Castlereagh City Council has awarded a contract for the collection, recycling, and/or recovery of wood from council household recycling centres, with Skipway Waste Management and Recycling being the active supplier. The tender was conducted as a limited procurement method, using direct award due to unforeseen cost increases associated with transport and processing, following Brexit and the impact of the Russia/Ukraine war. The contract value is £640,000, signed on 7th September 2022, with an extension allowed up to 30th July 2023.

This procurement opportunity can benefit businesses involved in refuse disposal and treatment services, especially those experienced in wood recycling and recovery. Businesses providing waste management solutions and collection services for mixed woods, timbers, and other recyclable materials would be well-suited to compete. The variation of the existing contract presents a chance for suppliers to offer innovative and cost-effective solutions to meet the council's requirements in diverting waste from landfill and promoting sustainable waste management practices.

Procurement Information

This relates to the variation of an existing contract. Proposed cost increases to the existing contract are attributable to the on-going increasing costs associated with transport and processing (eg fuel, particularly the move from red to white diesel, energy and staffing) which have been fuelled by Brexit and economies restarting following Covid. The Russia/Ukraine war has also exacerbated fuel and energy costs at a global level. The contract allows for a further and final extension of 12 months from 31 July 2022 to 30 July 2023. The council are content that it is reasonable to assume that contractors would not have foreseen the current cost increases in delivering services under the contract at time of tendering. This direct award is permitted by Regulation 72(1)(c) of the Public Contracts Regulations 2015 (c) where all of the following conditions are fulfilled:-- (i) the need for modification has been brought about by circumstances which a diligent contracting authority could not have foreseen; (ii) the modification does not alter the overall nature of the contract; (iii) any increase in price does not exceed 50% of the value of the original contract or framework agreement.
