Provision of Alternative Provider of Medical Services (APMS) Contracts under six Lots across Thurrock and Southend
Notice Description
This is a Contract Award Notice to communicate the outcome of a procurement for the provision of Alternative Provider of Medical Services (APMS) Contracts under six Lots across Thurrock and Southend. The Contracting Authority (hereinafter referred to as "the Authority") for this procurement was: NHS Mid and South Essex Integrated Care Board (ICB). The aim of the procurement was to award contracts for Lots 1, 2, 3, 4, 5 and 6, to deliver Primary Medical Services across all six Lots, via Alternative Provider of Medical Services (APMS) contracts. The services will continue to be provided at the existing sites and the Authority wish to ensure that there is no interruption to patients' continuity of care and access requirements. The Authority has undertaken a single one-stage procurement under the Light Touch Regime for all six contracts, with each acting as a separate and individual 'lot' and subsequent contract, to enable the mobilisation of the new provider from 1 April 2023 for Lots 1, 2 3, 4 and 6 and from 1st July 2023 for Lot 5. * Lot 1 - Y00999 - Oddfellows Health Centre & St Clements Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 2 - F81110 - Tilbury Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 3 - Y02807 - Thurrock Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 4 - F81206 - Commonwealth Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 5 - Y00033 - Purfleet Care Centre - commencing 1st July 2023 until 30th June 2038 * Lot 6 - F81684 - North Shoebury Surgery - commencing 1st April 2023 until 31st March 2038 The Authority procured all six lots as APMS contracts due to the time limited nature of them and flexibilities that they permit in terms of bidding audience e.g. whole of the market and the ability to agree the reporting schedules enabling KPIs that support delivery of the Long-term Plan and facilitates and enables the development of "at scale" provision through the PCN model of delivery. In line with the strategic aims for Mid & South Essex ICB, the system is committed to deliver primary care on a standard contract term to allow for delivery at scale and innovation by offering longer term arrangements. The aim was for each contract to be awarded for a period of 15 years to give greater certainty to the provider to improve value for money, ability to recruit, willingness to invest time and resources. The aggregate value of the contract across all 6 Lots including maximum Allowable Mobilisation Budget) as advertised in Find a Tender Service was proposed at PS91,153,559 (PS91,003,559 minus the maximum Allowable Mobilisation Budget). On 18th January 2023, the Authority published a Contract Award Notice in accordance with the Public Contracts Regulations 2015 (as amended by The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020) (2023/S 000-001557) to confirm an award was made for all six Lots to Spirit Healthcare Ltd, however since that time, the Contracts for each of the six Lots have not been able to be executed between the Preferred Bidder and the Authority, with sufficient time to ensure safe and effective mobilisation prior to 1st April 2023. As such this Corrigendum is being published to provide clarity to the market regarding the changes to the status of the procurement and award decision since 18th January 2023. A decision has been made by the Preferred Bidder to step away from the Contract and not proceed to signature. As such, a decision has been made by the Authority to cancel the procurement and put in place emergency arrangements with incumbent providers to ensure continuity of provision of Primary Care Services for the population associated with each of the six lots across Southend and Thurrock. Appropriate Notices will be issued to the market in due course to provide clarity about the Authority's intended approach.

The Services fall within Section 7 of the Public Contract Regulations 2015 (as amended The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020) (the \"Regulations\"). Neither the inclusion of a Selection Questionnaire / Qualification Stage, nor the use of the terms Open or One-Stage procedure, Invitation to Tender Process Overview, Invitation to Tender, nor any other indication shall be taken to mean that the Authority intend to hold themselves bound by any of the Regulations save those applicable to Public Contracts for Social and Other Specific Services listed in Schedule 3 of the Regulations (the \"Light Touch\" Regime). The Authority may wish to expand the Services during the lifetime of the contract (\"Contract modification(s)\"). To this end, the Bidder should be aware that after the award of contract, there is a possibility that the successful Bidder may be offered a variation(s) to the contract in accordance with Regulation 72 of the Public Contracts Regulations 2015 (as amended The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020), in the potential circumstances and or situations as further communicated in the ITT Process Overview. To this end, after the award of contract, there is a possibility that the successful Bidder may be offered a variation(s) to the contract in accordance with Regulation 72 of the Public Contracts Regulations 2015 (as amended The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020), in the following potential circumstances and or situations where necessary; 1. Appropriate alignment of the Service / Contract as a result of changes stipulated either nationally by NHSE&I or required locally by the Authority or it's partners in the Mid and South Essex Integrated Care System (MSE ICS), either to expand the service provision to include complementary Services, or to align the service to changes in need from the eligible service user population. 2. As a result of unanticipated changes in demand including drivers behind for the Service over the term, to support the successful Bidder to evolve the service slowly and sustainability to ensure successful implementation, and to ensure service safety and positive service user experience is maintained. 3. Where additional funding becomes available to the Authority for delivery of service requirements that are similar and or complementary to the Service already included in the Lot Specifications, at any given time, and do not modify the overall nature of the contract. Such expansion would be by the addition of services commissioned by the Authority or its partners across the MSE ICS, where the business case provides objective evidence that contract variation is the most appropriate course of action, taking account of one or more of the following considerations; service safety, financial and economic impact, innovation, patient and public acceptability, impact on health inequalities, strategic alignment with National/Regional/Local strategic priorities, ability to improve multiple pathways, positive contribution to improved supply / improving service responsiveness, patient experience and health economy impact.",

"description": "This is a Contract Award Notice to communicate the outcome of a procurement for the provision of Alternative Provider of Medical Services (APMS) Contracts under six Lots across Thurrock and Southend. The Contracting Authority (hereinafter referred to as \"the Authority\") for this procurement was: NHS Mid and South Essex Integrated Care Board (ICB). * Lot 1 - Y00999 - Oddfellows Health Centre & St Clements Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 2 - F81110 - Tilbury Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 3 - Y02807 - Thurrock Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 4 - F81206 - Commonwealth Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 5 - Y00033 - Purfleet Care Centre - commencing 1st July 2023 until 30th June 2038 * Lot 6 - F81684 - North Shoebury Surgery - commencing 1st April 2023 until 31st March 2038 The Authority procured all six lots as APMS contracts due to the time limited nature of them and flexibilities that they permit in terms of bidding audience e.g. whole of the market and the ability to agree the reporting schedules enabling KPIs that support delivery of the Long-term Plan and facilitates and enables the development of \"at scale\" provision through the PCN model of delivery. Appropriate Notices will be issued to the market in due course to provide clarity about the Authority's intended approach.",

The ICB has determined that there is a need for services to remain at the existing sites and therefore in order to ensure that there is no interruption to patients' continuity of care and access requirements, and is therefore undertaking a single one-stage procurement under the Light Touch Regime for all six contracts, with each acting as a separate and individual 'lot' and subsequent contract, to enable the mobilisation of a new provider from 1 April 2023 for five of the contracts, and 1st July 2023 for one of the contracts. Lot 1 - Y00999 - Oddfellows Health Centre & St Clements Health Centre - actual list of 11,800 as at 1st April 2022 Lot 2 - F81110 - Tilbury Health Centre - actual list of 12,178 as at 1st April 2022 Lot 3 - Y02807 - Thurrock Health Centre - actual list of 12,502 as at 1st April 2022 Lot 4 - F81206 - Commonwealth Health Centre - actual list of 5,740 as at 1st April 2022 (THIS LOT) Lot 5 - Y00033 - Purfleet Care Centre - actual list of 6,358 as at 1st April 2022 Lot 6 - F81684 - North Shoebury Surgery - actual list of 6,394 as at 1st April 2022 The ICB is procuring all six lots as APMS contracts due to the time limited nature of them and flexibilities that they permit in terms of bidding audience e.g. whole of the market and the ability to agree the reporting schedules enabling KPIs that support delivery of the Long-term Plan and facilitates and enables the development of \"at scale\" provision through the PCN model of delivery. In line with the strategic aims for Mid & South Essex ICB, the system is committed to deliver primary care on a standard contract term to allow for delivery at scale and innovation by offering longer term arrangements. It is proposed that each contract will be awarded for a period of 15 years; Lots 1 to 4 and Lot 6 from 01/04/23 - 31/03/38, and Lot 5 from 01/07/23 - 31/03/38. "text": "The Contracting Authority (hereinafter referred to as \"the Authority\") for this procurement was NHS Mid and South Essex Integrated Care Board (ICB). On the 6th October 2022, the Authority invited responses from suitably qualified and experienced providers (via publication of a Contract Notice in FTS, reference 2022-043094) to deliver Primary Medical Services across up to six Lots, via Alternative Provider of Medical Services (APMS) contract(s) for a period of 15 years. Contracts for Lots 1 to 4 and Lot 6 will run from 01/04/23 - 31/03/38, and the contract for Lot 5 will run from 01/07/23 - 30/06/38. The aggregate value (forecasted financial entitlement) of the contract across all 6 Lots is PS91,153,559, including up to PS25,000 Allowable Mobilisation Budget on a cost incurred basis, per Lot, in Year 1). (The financial entitlement across all six Lots, minus the allowable mobilisation budget is PS91,003,559). The Lots: * Lot 1 - Y00999 - Oddfellows Health Centre & St Clements Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 2 - F81110 - Tilbury Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 3 - Y02807 - Thurrock Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 4 - F81206 - Commonwealth Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 5 - Y00033 - Purfleet Care Centre - commencing 1st July 2023 until 30th June 2038 * Lot 6 - F81684 - North Shoebury Surgery - commencing 1st April 2023 until 31st March 2038 The Authority has procured all six lots as APMS contracts due to the time limited nature of them and flexibilities that they permit in terms of bidding audience e.g. whole of the market and the ability to agree the reporting schedules enabling KPIs that support delivery of the Long-term Plan and facilitates and enables the development of \"at scale\" provision through the PCN model of delivery. In line with the strategic aims for Mid & South Essex ICB, the system is committed to deliver primary care on a standard contract term to allow for delivery at scale and innovation by offering longer term arrangements. As such, each contract has been awarded for a period of 15 years to give greater certainty for provider to improve value for money, ability to recruit, willingness to invest time and resources. We want to secure the right fit for the specific needs of that population. The contract that is being entered into by the Authority and the Preferred Bidder will be governed by the Standard Alternative Provider of Medical Services (APMS) Contract."

"text": "This is a Contract Award Notice to communicate the outcome of a procurement for the provision of Alternative Provider of Medical Services (APMS) Contracts under six Lots across Thurrock and Southend. The Contracting Authority (hereinafter referred to as \"the Authority\") for this procurement was: NHS Mid and South Essex Integrated Care Board (ICB). * Lot 1 - Y00999 - Oddfellows Health Centre & St Clements Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 2 - F81110 - Tilbury Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 3 - Y02807 - Thurrock Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 4 - F81206 - Commonwealth Health Centre - commencing 1st April 2023 until 31st March 2038 * Lot 5 - Y00033 - Purfleet Care Centre - commencing 1st July 2023 until 30th June 2038 * Lot 6 - F81684 - North Shoebury Surgery - commencing 1st April 2023 until 31st March 2038 The Authority procured all six lots as APMS contracts due to the time limited nature of them and flexibilities that they permit in terms of bidding audience e.g. whole of the market and the ability to agree the reporting schedules enabling KPIs that support delivery of the Long-term Plan and facilitates and enables the development of \"at scale\" provision through the PCN model of delivery. The Services fall within Section 7 (Social and Other Specific Services) listed in Schedule 3 of the Regulations (the \"Light Touch\" Regime)."
