The Supplier identified is the only supplier who can meet the technical requirements (supporting the justification that the (ii)competition is absent for technical reasons,) In addition to the IP being developed collaboratively with the identified Supplier and UKRI. Therefore supporting the main justification (iii)the protection of exclusive rights, including intellectual property right. This is in accordance with Regulation32. 2 b - where the works, supplies or services can be supplied only by a particular economic operator.
