GMS Contract for Culverhay Surgery
Notice Description
NHS Gloucestershire ICB ("the ICB") held a General Medical Services (GMS) contract ("the Frampton Contract") with the Partners of Frampton Surgery (patient list size circa 5,275) for the provision of primary care services from Frampton Surgery, Frampton on Severn. The ICB also holds another GMS contract ("the Culverhay Contract") with the Partners of Culverhay Surgery (patient list size circa 12,160) for the provision of primary care services from Culverhay Surgery, Wotton-under-Edge. The Frampton Contract had become unviable as a standalone contract. The ICB therefore decided to terminate the Frampton Contract and incorporate the Frampton patient list into the Culverhay Contract by way of variation to the Culverhay Contract. The Frampton Surgery is now a branch surgery of the Culverhay Surgery. The Culverhay Contract is subject to the provisions of Chapter 3, Section 7 of the Public Contracts Regulations 2015 ("the PCR"). The ICB has relied on PCR 72(1)(b) and 72(1)(e) to effect a permitted variation to the Culverhay Contract to incorporate the Frampton Surgery as a branch surgery. The variation took effect on 1 January 2023.

Lot 1
This section provides detail of the services covered by the Culverhay Contract and the variation of the Culverhay Contract. The Culverhay Contract is held between the ICB and the Partners of Culverhay Surgery, Wotton-under-Edge and covers the provision of primary care services to the patients registered with Culverhay Surgery. It is a GMS Contract that is subject to the requirements of the National Health Service (General Medical Services Contracts) Regulations 2015 (as amended). The Culverhay Contract has an indefinite term. A separate GMS contract for the provision of primary care services from the Frampton Surgery in Frampton on Severn recently became unviable as a standalone contract on the basis of, among other things, GP resourcing issues and costs. The Frampton partners therefore served notice to terminate the Frampton Contract and the ICB has transferred the Frampton patient list to the Culverhay Surgery by way of variation to the Culverhay Contract. The effect of the variation is to increase the number of patients managed under the Culverhay Contract from some 12,000 patients to some 17,000 patients. Funding paid by the ICB under the Culverhay Contract will therefore increase on an annual basis from PS1,250,050 to PS1,778,473. The value of the procurement listed in section II.1.7 is the value of the modification over four years.
Procurement Information
The ICB has relied on Regulations 72(1)(b) and 72(1)(e) of the PCR to effect a permitted variation to the Culverhay Contract to incorporate the Frampton Surgery as a branch surgery. The contract is for Light Regime services under the PCR. The ICB considers that the variation to the Culverhay Contract is permitted pursuant to Regulation 72(1)(b) of the PCR on the basis that it has become necessary for the Culverhay partners to deliver primary care services to the patients of the Frampton Surgery under the Culverhay Contract because a change of contractor would cause significant inconvenience for the ICB and a risk to continuity of care for patients. This is on the basis that the Frampton Contract proved unsustainable in part due to the very small size of the patient list. Combining with another practice will assist with long term sustainability and improve the ICB's ability to attract and retain staff. In addition, or in the alternative, the ICB considers that the variation to the Culverhay Contract is permitted pursuant to Regulation 72(1)(e) of the PCR on the basis that the change to the Culverhay Contract is not substantial. The variation will not render the Culverhay Contract materially different in character from the one initially concluded, would not have affected the outcome of the original procurement procedure, does not change the economic balance of the contract and does not extend the scope of the contract considerably. The Culverhay Contract will be for the delivery of the same services on the same terms, but amended to include delivery of those services from the Frampton Surgery with a larger patient list.
