Summary of the contracting process

The National Health Service (NHS) Scotland, represented by The Common Services Agency (NSS), has completed a tender process for the supply of Aflibercept (Eylea®) pharmaceutical products. The procurement was carried out using a limited procurement method, specifically an award procedure without prior publication of a call for competition. The tender has been successfully awarded to Bayer Plc, with a contract value of £54,711,495 signed on 8th November 2023. This opportunity was aimed at providing pharmaceutical products to NHS Scotland through a single supplier framework agreement.

This procurement presents potential business opportunities for pharmaceutical suppliers looking to engage with large-scale contracts within the healthcare industry. Companies operating in the pharmaceutical sector, particularly those capable of meeting the exclusive rights and intellectual property requirements, would be well-suited to compete in similar tender processes. For businesses seeking growth in supplying pharmaceutical products to public healthcare authorities, monitoring and participating in such tender opportunities can be a strategic initiative to expand their market presence and revenue streams.

The bringing of court proceedings against the authority during the standstill period will automatically continue the prohibition on entering into the framework agreement until the court proceedings are determined, discontinued or disposed of, or the court, by interim order, brings to an end the prohibition. The remedies that may be awarded by the courts before the framework agreement has been entered into include the setting aside of the decision to award the framework agreement to the winning tenderer. The bringing of court proceedings against the authority after the framework agreement has been entered into will not affect the framework agreement unless grounds for the imposition of special penalties under the Public Contracts (Scotland) Regulations 2015 can be established.
