Summary of the contracting process

This contract involves the procurement process managed by Sellafield Limited, located in Warrington, for the supply of radiometric protection instruments, spares, and consumables specifically from the supplier Mirion Technologies (Canberra UK) Ltd. It is classified under Nuclear, biological, chemical, and radiological protection equipment, with procurement focused on goods and the contract categorized as an award without prior publication of a call for competition, due to the supplier's exclusive Intellectual Property Rights. The procurement, which has its principal location in the UKD1 region, is in its completion stage, having been signed on 2nd October 2025, with a total contract value of GBP 8,500,000. The task ensures continuity and compatibility in operation and maintenance, operating under the legal framework defined by the Public Contracts Regulations 2015 due to the absence of competition for technical reasons.

This tender presents significant opportunities for businesses specialising in the provision and maintenance of specialised nuclear safety equipment, especially those capable of supporting complex, safety-critical environments. Given that the procurement process recognises intellectual property exclusivity, businesses with proprietary technologies or compatible enhancements can leverage such contracts to establish a strong market presence. While Mirion Technologies holds the rights for this specific supply, other companies with complementary expertise or services may find growth opportunities in collaborative ventures or in the broader nuclear safety industry ecosystem. This environment is particularly advantageous for organisations positioned around innovation and highly specialised technological solutions.

Notice Information

Notice Title

Agreement for the Supply of Radiometric Protection Instruments - Spares and Consumables

Notice Description

The contract is for acquiring supplies from the supplier (Mirion) to prevent difficulties in operation and maintenance of the Mirion radiometric support equipment, ensuring the supplies used are that of the suppliers own equipment (to which the supplier has the Intellectual Property Rights and patents) so that:

- The Radiometric protective equipment is correct and is part of a set of pre-approved type tested equipment which has been evaluated and considered fit and safe for the intended purpose.

- The spares in use meet a predetermined specification which matches the equipment outlined above. As the OEM, the supplier is required to ensure that their spares continue to meet that specification.

The supplier retains the intellectual property rights (IPR) for the Radiometric Protection Instruments, restricting the ability of another economic operator to provide the supplies.

Lot Information

Lot 1

The contract was awarded to the supplier (Mirion) to maintain an ongoing supply of pre-approved spares and consumables to maintain the most robust and safe use of the Mirion equipment. The contract will enable the supplier to continuously support the timely supply of the correct spares required.

As the supplier retains Intellectual Property Rights (IPR) this restricts the ability of another economic operator to provide the supplies and ensure the safe operation and maintenance of Mirion equipment on site. Additional information: The service provider retains the Intellectual Property Rights (IPR) relating to Regulation 32(2)(b)(iii) PCR 2015 (the protection of exclusive rights, including intellectual property rights). Regulation 32(2)(b)(ii) PCR 2015 (competition is absent for technical reasons) also applies. Regulation 32(5)(b) PCR 2015 also applies.

Procurement Information

The service provider retains the Intellectual Property Rights (IPR) for the supplies, and would restrict the ability of another economic operator to provide the supplies, with justification for contract award on the grounds of Regulation 32(2)(b)(iii) PCR 2015 (the protection of exclusive rights, including intellectual property rights). Regulation 32(2)(b)(ii) PCR 2015 (competition is absent for technical reasons) also applies.

Regulation 32(5)(b) PCR 2015 also applies (for additional deliveries by the original supplier which are intended either as a partial replacement of supplies or installations or as the extension of existing supplies or installations where a change of supplier would oblige the contracting authority to acquire supplies having different technical characteristics which would result in incompatibility or disproportionate technical difficulties in operation and maintenance).
