Framework Agreement for the Provision of Short Notice Transport
Notice Description
The Council currently receive a high number of short notice, short duration requests for transport which we have a statutory duty to deliver. For example, transport may be required immediately, within the same day or next day and the duration of the requirement may only be a single journey. To address the Council's statutory duty to fulfil urgent transport requests, a framework agreement is being established specifically for the provision of short notice transport services. Through this framework, the Council will appoint a number of qualified suppliers, creating a reliable pool of suppliers capable of responding swiftly to the Council's requirements. This arrangement enables the Council to offer short notice, short term transport contracts directly to approved suppliers via telephone, without the need for a further competitive procurement process. This approach ensures that transport can be organised and delivered within the tight timescales that such circumstances demand, maintaining compliance and service continuity. Most transport requirements under the framework will involve social care or home-to-school trips, but the framework will also cover the provision of any type of short-notice transport requirement (with the exception of ambulance/medical transport).

Lot 1
Lot 1 comprises the provision of short notice passenger transport in small vehicles (up to 8 passenger seats) with coverage of the following geographical areas: LE4 Beaumont Leys, Birstall LE5 Hamilton, Thurnby Lodge LE2 Oadby LE18 Wigston LE19 Narborough, Enderby LE3 Braunstone, Glenfield
Options: As this is a new service the usage and therefore spend is difficult to accurately estimate. The Council therefore reserves the option to make additional purchases of journeys under the framework agreement which may mean spend exceeds the advertised estimated contract value of PS80m. Any options taken will be within the permitted criteria set out in the Procurement Act 2023 in relation to contract modifications.
Renewal: 2 x 12 month extensions available at end of initial contract term.
Lot 2Lot 2 comprises the provision of short notice passenger transport in small vehicles (up to 8 passenger seats) with coverage of the following geographical areas: LE65 Ashby de la Zouch LE67 Coalville LE6 Ratby, Groby LE11 Loughborough LE12 Shepshed, Barrow upon Soar, Belton DE11 Swadlincote, Church Gresley, Newhall, Midway, Albert Village, Hartshorne DE12 Swadlincote, Appleby Magna, Linton, Measham, Overseal, Rosliston, and Walton-on-Trent DE73 Chellaston, Melbourne, Ticknall, Swarkestone, Barrow-upon-Trent DE74 Castle Donington, Kegworth, Hemington.

"description": "1. On completion of the evaluation process, Suppliers will be ranked within Lots according to the total score out of 100% they achieved for each service type they bid for. 2. The Council will produce a supplier matrix, showing which Suppliers have been appointed to the framework, what Lots they have been appointed to, the transport services they have been appointed to deliver, the price per mile rate and the Suppliers ranking within each Lot. 3. When the Council has a requirement for short notice transport it will inspect the supplier matrix to ascertain who is the first ranked Supplier within the appropriate Lot for the type of transport service required. 4. Lot selection will be based on the starting point of the journey. Where any journey starts outside of a Leicestershire postcode the nearest Leicestershire postcode to the start point will be used for Lot selection purposes. 5. The Council will contact the Supplier ranked first within the appropriate Lot (i.e. the Supplier with the highest total score) for the provision of that service type to offer that Supplier the available contract. If the Supplier ranked first cannot provide the required transport, the Council would approach the second highest ranked Supplier and offer that Supplier the contract and so on until a Supplier is identified who can provide the transport required. 6. Due to the short notice time constraints initial contact will be by telephone with verbal agreement of the contract award, at which point the contract will be formed, to be followed by the issue of an official order form from the Council as soon as practicably possible. 7. In circumstances where telephone contact cannot be made with the first ranked Supplier (e.g. the first ranked Supplier does not answer the telephone), the Council reserves the right to immediately contact the second ranked Supplier to offer that Supplier the contract and so on until a Supplier is identified who can provide the transport required. This is to ensure the transport requirement is met in the short timescale required. 8. Prior to awarding a contract to a Suppler, the Council reserve the right to inspect and re-assess the Supplier's compliance documents (such as insurance certification, licence documents and DBS documents etc.) to ensure the Supplier remains in compliance with the compliance requirements of the framework agreement. Further Competition 9. The Council may, on rare occasions, conduct a further competition to determine which Supplier to award a call-off contract to. When conducting a further competition under the Framework Agreement the Council shall: * identify the relevant Lot(s) that the service requirements fall into * identify the Framework Suppliers capable of performing the Contract for the Services required (under the relevant Lot) * supplement and refine the deliverables/call-off Terms and Conditions to reflect its requirements * invite identified Framework Suppliers to submit methodologies and prices for the provision of the Services in accordance with the Council's requirements and in particular: (a) consult in writing the Framework Suppliers capable of performing the Contract for the Services and invite them within a specified time limit to submit a Supplemental Tender (b) set a time limit for the receipt by it of the Supplemental Tenders which takes into account factors such as the complexity of the subject matter of the Contract and the time needed to submit tenders (c) keep each Supplemental Tender confidential until the expiry of the time limit for the receipt by it of the Supplemental Tenders (d) set the award criteria within the ranges set out in the table below and apply the same to any compliant Supplemental Tenders submitted through the further competition (e) determine if the Framework Supplier is an excluded supplier or excludable supplier (including by reference to an associated person) as set out in Section 57 of the Procurement Act 2023; and only proceed with the award if the Supplier is not an excluded supplier; and (f) place a request for services with the successful Framework Supplier. "riskDetails": "The following known contract risks have been identified. The risks are not listed in any order of priority or importance. Should any risk materialise the Council would seek to rely on the provisions of Schedule 8 of the Procurement Act 2023 (Permitted Contract Modifications) to modify the Terms and Conditions of Contract contained within Appendix D of the tender documents and /or the Specification, the operation of the framework, the scope of the framework, the duration of the framework and any call-off contracts issued under it, the EPP SPA, the overall Framework Agreement value and/or individual Lot contract values. Any proposed modifications will be communicated to suppliers prior to implementation and will go no further than necessary to treat the materialised risk : a. Financial Risk - the Council spends more than the estimated contract value advertised in the Tender Notice through the framework agreement, due to higher demand which cannot be estimated at the tender stage. As this is a new service it is not possible to accurately estimate what the spend through the framework will be, either overall or on an individual Lot basis. Individual Lot values of PS20m per Lot have been split evenly for the purpose of the Tender Notice as no historic spend data is available and as the service is demand led, no accurate estimate can be made of what future spend may be under any individual Lot. Individual Lot values may therefore increase or decrease throughout the life of the framework requiring modification to individual Lot values. b. Financial Risk - National or local policy changes in relation to the provision of the types of transport required under the framework means the Council usage of the framework is less than anticipated. Suppliers are reminded that the Council gives no guarantees as to the level of business available under either the overall framework or individual Lots. c. Legislative or Regulatory Risk - changes to legislation or regulations pertaining to the delivery of transport services necessitates a change to the specification or terms and conditions of contract. d. Local Government Re-Organisation (LGR) Risk - LGR may affect the Council's requirements under this framework agreement. e. Council Policy, Priorities and Strategic Outcomes Risk - the Council may change its stated policies, priorities and/or strategic outcomes which may affect the Councils requirements under this framework. f. Council Process Change Risk - the Council from time to time may change its processes which may affect this framework. Changes could include, but are not limited to, invoice payment processes, implementation of mandatory No Purchase Order, No Pay policy, data protection processes, safeguarding processes, health and safety processes, supplier training requirements etc. This list is not exhaustive and process changes could apply to any aspect of the Council's operations. g. Specification Risk - the Council identifies areas (which could not have been identified at award stage) where service delivery or safeguarding provisions requires improvement. h. Framework Process Risk - After the framework is implemented, the Council and/or suppliers may identify operational aspects that are not functioning as intended. i. Force Majeure, Global or Local Events Risk - Force Majeure, global or local incidents occur which impacts the delivery of services under the framework agreement. These may include, but are not limited to, force majeure events as defined in Schedule 2 (Definitions) of the Framework Agreement, and other incidents/events such as adverse weather, school closures, closure of social care establishments etc. J. Resource Risk - Unforeseen events leads to a lack of supplier resource within the market (e.g. a shortage of vehicles, fuel, drivers or escorts) which impacts on the Suppliers ability to deliver the service. K. DBS Update Service Risk - the Authority may require the use of the DBS Update Service during the term of the Framework."
