Summary of the contracting process

Cumberland Council, acting as lead authority for Cumberland Council and Westmorland and Furness Council, procured a county-wide substance use treatment service for Cumbria. The service is intended to prevent harm from drug and alcohol misuse and support recovery, addressing a significant public health need and health inequalities across the county. The scope covers addiction treatment, rehabilitation and community health services. Delivery is across Cumbria. This is a public health and community care requirement for organisations able to provide integrated substance misuse treatment and recovery support to people throughout the area, working with both councils and relevant health and community partners.

The procurement reached award stage, but the resulting contract was cancelled. It used an open procedure under the Provider Selection Regime for health care services. Two valid bids were received. Waythrough was awarded the service on 30 April 2026 for £56 million excluding VAT, or £67.2 million including VAT. The initial contract period was 1 October 2026 to 30 September 2032, with two optional extensions of up to 24 months each, allowing a maximum end date of 30 September 2036. Evaluation weighted quality at 70%, price at 20% and social value at 10%; minimum 50% scores applied to each quality question and the social value question. Waythrough decided not to proceed, and the contract was cancelled on 3 July 2026.

This requirement shows demand from the two councils for a substantial, long-term substance misuse treatment service covering an entire county. A credible future provider would need to deliver addiction treatment, rehabilitation and community health support at scale, with the operational capacity to serve dispersed communities across Cumbria. The evaluation places greatest emphasis on service quality, while also requiring a strong social value offer and competitive pricing. Suppliers should therefore be able to evidence effective treatment and recovery outcomes, robust clinical and community delivery, partnership working, safeguarding and mobilisation capability. The opportunity is suitable for SMEs and voluntary, community or social enterprises, and the previous competition included both a large VCSE provider and a large commercial provider.

Notice Description

Cumberland Council, acting as lead authority on behalf of both Cumberland Council and Westmorland and Furness Council, has procured a provider for the provision of the Cumbria Substance Use: Treatment Service, for a term of up to 10 years. Under the Health and Social Care Act 2012, local authorities have a statutory responsibility for improving public health, which includes commissioning services that prevent harm and support recovery from substance misuse. This responsibility is reinforced by national guidance and the Office for Health Improvement and Disparities (OHID) commissioning standards. Substance misuse remains a major public health challenge in Cumbria, with high rates of drug- and alcohol-related deaths and significant health inequalities across the county. The estimated total value of the contract over the total contract period (including any extension period) is a maximum value of up to PS56m excluding VAT, but no guarantee is given as to the actual value of the contract. The initial contract period is six years, running from 1st October 2026 to 30th September 2032. Two optional extension periods of up to 24 months each are available. If both extensions are utilised, the contract will end on 30th September 2036. Use of these extensions is entirely at the discretion of the Council. Bids were evaluated according to the criteria as set out in the Invitation to Tender. This contract has been awarded in accordance with the Provider Selection Regime (PSR) under the Health Care Services (Provider Selection Regime) Regulations 2023. In accordance with Regulation 12 of the Health Care Services (Provider Selection Regime) Regulations 2023, the contracting authority shall observe a standstill period of eight working days following publication of the notice of intention to award
