Notice Description

West Kent Housing Association is seeking long-term pest control service provider(s), for the treatment of statutory pest infestations relating to: Lot 1: insects (eg cockroaches and wasps), rodents (eg rats, squirrels, and mice) and similar pests. Lot 2: birds including pigeons. Removal of bees' nests is specifically excluded from this procurement. The initial contract term will be 5-years, incorporating a break clause for both no-fault and breach of contract, with the provision for extension for up to 3-years performance depending. The form of contract will be West Kent's own Services Agreement, with embedded data processing agreement and supplemental schedules.

The British Pest Control Association were consulted on 10 February 2026 regarding route to market options and preparation of an outline specification. Incumbent suppliers were then invited to meet with the client contract manager on 25 February 2026 to inform them of the forthcoming tender process, gain insights into the market, discuss suggestions for the refreshed specification and suitable pricing document and how these might be used to best effect going forwards. This was particularly focussed on the logistics and processing of orders, in conjunction with West Kent’s housing management system. (Residents of West Kent will be consulted, in accordance with Section 20 of the Landlords and Tenants Act 1985 (as amended), though nominations will not be requested, as the contract will be a Qualifying Long-Term Agreement where a Public Notice is issued (Schedule 2). Section 20 consultation therefore falls outside of the preliminary market engagement process.)

            "financialTerms": "Each invoice submitted by the Service Provider shall set out: (a) the amount that the Service Provider considers due as the Charges for the provision of the Services (calculated in accordance with the rates and prices set out in the Pricing Schedule); (b) a brief but sufficiently detailed description of the Services carried out, and the dates on which the Services were commenced and completed; (c) any deductions, additions or adjustments agreed in writing by the Client; (d) the information specified in the Services Specification; (e) and be in the format specified in the Services Specification or as otherwise agreed between the Parties; and (f) any other information or documents which the Client has given notice to the Service Provider that it considers is necessary, in its discretion, to approve payment before any payment in respect of invoice shall be considered by the Client. All invoices submitted by the Service Provider shall comply with Regulations 13 and 14 of the Value Added Tax Regulations 1995 (SI 2518) and shall be supported by all such documents vouchers and receipts as may be necessary for computing and verifying them. The Client shall be entitled to set-off from any monies due to the Service Provider any monies owed to the Client under this Contract or under any other contract between the Client and the Service Provider. The Client shall be entitled to withhold payment of any invoice that is not submitted within the timeframes set out in the Contract and/or that does not comply with the requirements of the relevant clause in the Contract. Any disputed invoices will be paid within thirty (30) days of the date of resolution of the dispute provided that such resolution shows monies are owing to the Service Provider. Payment by the Client shall be without prejudice to any claims or rights which the Client may have against the Service Provider and shall not constitute any admission by the Client as to performance by the Service Provider of its obligations under this Contract. If the Client fails to make any payment which is due in full on the due date the Service Provider may charge the Client interest (both before and after judgement) on the amount unpaid from time to time at the rate of 2% above the Bank of England's base rate from time to time, and the Parties agree that this constitutes a substantial remedy for the purposes of the Late Payment of Commercial Debts (Interest) Act 1998 and associated legislation. All sums payable under this Contract are exclusive of any applicable value added tax which will be added to each invoice at the applicable rate at the time and will be paid for by the Client. For the avoidance of doubt the Charges include all the Service Provider's costs for providing the Services, however incurred, but not limited to, the costs of labour, vehicles, machinery, equipment materials and travelling expenses."

        "riskDetails": "Contract may be modified due to: - Additional types of pest identified which are not currently covered by the Specification. - If the Supplier appointed to one Lot fails or is unable to fulfil the requirements of any one or more instructions, the scope of service may be offered to the Supplier on the other Lot. - An unforeseen, significant, infestation of one or more type of pest. - Changes in legislation / regulation affecting method statements, use of pest control products, or other relevant factors. - Technological advances impacting on delivery of the service. - Changes in budgetary constraints and / or housing stock levels. - Other unforeseen issues arising that could not be identified or assessed prior to contract award."
