Notice Description

Torbay Council is seeking a Provider to deliver a Specialist Stop Smoking Service in Torbay. The service will support adult residents to take steps towards reducing and quitting smoking and long term vaping. The service to be delivered will comprise: * Delivery of regular campaigns to keep reducing and quitting in people's minds, * Establishing and training a network of people working and volunteering across Torbay who can deliver smoking and vaping advice, * Provision of self-directed support tools, * Behavioural and pharmacological support delivered in person, over the phone and through a fully digital, app based service, * Delivery of outreach support to improve engagement and outcomes for underserved groups. The Provider will be expected to ensure a competent workforce, delivery to national guidance, and strong partnership working to reduce smoking prevalence across the locality, in line with the UK Government's smokefree 2030 ambition.

            "financialTerms": "In consideration of the provision of the Services by the Supplier in accordance with the terms and conditions of this Contract, the Authority shall pay the Charges to the Supplier. The Charges shall be calculated as set out in the Payment Schedule. Unless otherwise stated in the Payment Schedule the Charges: (a) shall be payable from the Commencement Date; (b) shall remain fixed during the Term unless agreed by both parties; and (c) are the entire price payable by the Authority to the Supplier in respect of the Services and includes, without limitation, any royalties, licence fees, supplies and all consumables used by the Supplier, travel costs, accommodation expenses and the cost of Supplier Personnel. The Authority shall pay each properly submitted invoice received by the Supplier within 30 days of the date when Authority has determined that the invoice is a valid and undisputed invoice, and each invoice must contain the Authority's Purchase Order number. The Supplier shall accept payment electronically via BACS. Further information on payment terms can be found in Clause 6 Charges and Payments of the Service Contract."

A change to the needs of clients presenting to the service, requiring additional services or interventions to be provided that currently are not in scope. The service evaluation may bring about changes to scope as a consequence to feedback received; this is to ensure services continue to meet the needs of service users and staff in the future. Modification required if risk arises: The Authority will work with the Supplier collaboratively to determine a solution. Risk 2: Description of risk: Remodelling of the Contract's service elements and deliverables described within the Specification. This could be due to: Changes in legislation, NICE guidance, quality standards and/or best practice, relating to services being provided under this Contract. The changing needs of service users. The changing geographical footprint of Torbay local authority boundary due to a result of Local Government Reorganisation reforms. Changes in data reporting systems used as determined by developments made by NHS Digital and / or the Office for Health Improvement and Disparities. Modification required if risk arises: This would be discussed and agreed between the Authority and the Supplier, using appropriate evidence and cost modelling specific to the change required. This may involve the absorption of other services currently outside of the Torbay geographical area including TUPE of staff. The Supplier will be responsible for providing calculations and supporting information of costs to the Authority where applicable. Risk 3. Description of risk: Change to service requirements as a result of unforeseen circumstances including but not limited to: New government legislation, mandate, and / or policy. Changes to existing government legislation, mandate and / or policy. Public health or other critical events. Modification required if risk arises: The Authority will work with the Supplier collaboratively to determine a solution. Modifications may be required to maintain or adapt service delivery and results in different structures, delivery models, interventions, or other requirements (e.g. responsibility for commissioning Treating Tobacco Dependence is transferred from the NHS to the local authority). Future epidemics or pandemics may result in the requirement of the services to rapidly stand up, increase, suspend, or terminate contacted elements in response to these outbreaks, or equivalent issues. Changes would be evaluated on a case-by-case basis, and any additional costings or return of any accrued underspend would be agreed upon by both parties, ensuring the budget remains aligned with the revised scope of services including the return of any unrequired funds paid in advance. Risk 4. Description of risk: Take on management of the contract for the PGD for Varenicline dispensing in Pharmacies (currently held directly between Torbay Council and Pharmacies), to ensure the continued efficiency and effectiveness of service provision. Modification required if risk arises: This would be discussed and agreed between the Authority and the Supplier using appropriate evidence and cost modelling specific to the change required. The Authority will provide the Supplier with current contractual terms and fee structures to support the transition. Risk 5. Description of risk: Take on management of the contract for stop smoking prescribing in GP practices (currently held directly between Torbay Council and GP pharmacies), to ensure the continued efficiency and effectiveness of service provision. Changes required might be due to the implementation of the Integrated Care System and/or closer working between Local Authorities which may change the footprint of the commissioned service. Modification required if risk arises: This would be discussed and agreed between the Authority and the Supplier using appropriate evidence and cost modelling specific to the change required. The Authority would provide the Supplier with current contractual terms and fee structures to support the transition."
