Prison Operator Services Competition - HMP Rye Hill - UK4 Tender Notice
Notice Description
HMP Rye Hill is a Category C training prison in the village of Willoughby, near Rugby in Warwickshire. It holds 1,122 prisoners. Operated by G4S, it opened in 2001 as a Category B prison for adult males. Under this procurement, the Ministry of Justice (MoJ) (the Authority) is seeking a single operator to manage and maintain both the prison regime and the prison facilities at HMP Rye Hill. The Authority has procured contracts for the operation of prisons by the private sector since the early 1990s and continues to support a mixed economy of public, voluntary, and private sector involvement. The current contract for HMP Rye Hill will expire on 20 January 2028. Scope of Services The Prison Operator Services contract (also referred as "prison management" in global markets) includes: * Operational custodial services: education, rehabilitation, training, work, security and resettlement * Facilities Management ("FM"): both hard and soft FM services The contract is based on the Cabinet Office Model Services Contract and is designed to ensure safe, secure and transformative prison operations that reduce reoffending and maintain high standards. The Authority aims to ensure a safe and efficient transfer of services with minimal disruption to staff and prisoners, while modernising the prison to ensure it is fit for the future. Procurement Documentation Details of the procurement can be found in the Invitation to Tender (ITT) documents which are structured into three volumes and are located in Ministry of Justice's e-Sourcing Portal (Jaggaer). Volume 1: Introduction, Instructions, and Procurement Process - providing instructions on the completion and submission of tenders, including indicative timelines. Volume 2: Bidder Response Criteria and Assessment Methodology - providing details of the Response Criteria Bidders are required to cover in their Bids, together with guidance on completion of Bidder responses against each criterion. This volume also provides details of the evaluation methodology by which the Bid will be evaluated and the award criteria. Volume 3: The Draft Contract - providing the draft Framework Agreement and a Model Call-Off Contract, that will form the basis of Prison Operator Services delivery for any Mini-Competition run in accordance with the Call-Off Procedure. Contract Duration The anticipated contract duration is 12 years from the operational services commencement date with: - An option to extend by up to 3 years (1+1+1) - A break clause 6 years from the Service Commencement Date

The Authority is pleased to confirm that it will be facilitating the second site visit to HMP Rye Hill which will be 1-1 site visits on Wednesday 20th May 2026 and Thursday 21st May 2026. The site visit will be split into two sessions on both days as follows: Morning – 10:00am-12:00pm Afternoon – 2:00pm-4:00pm The Authority can confirm that you are allowed to bring a maximum of four attendees on this visit. To ensure the site visit is as informative and productive as possible you will need to identify specific areas you would like to focus on during the visit. For the avoidance of doubt, the Authority will not accept generic requests from Suppliers to visit the whole site. Suppliers should note that there will be further opportunity to visit the site during the competition. Therefore, the Authority would be grateful if you could provide specific detail/ explanation of the areas you wish to visit. Please also confirm whether there is a session or day that they cannot attend by this deadline. For the avoidance of doubt, you are only invited to attend one session on one of the days and not multiple sessions on one or both days. The Authority will confirm which session you are invited to attend shortly after the deadline. "features": "Stage 1: Conditions of Participation 1.1 Stage 1 commenced with the issuing of a Tender Notice and the publication of the procurement documents relating to this Competition. 1.2 The procurement documents include a Procurement Specific Questionnaire which all Bidders are required to complete and return in accordance with paragraph 4.7 (timetable for the competition) of Volume 1 of the ITT documentation and the instructions within this Invitation. 1.3 Bidders that wish to participate in this Competition are responsible for ensuring that the Central Digital Platform contains complete, accurate and up-to-date information in accordance with the relevant requirements set out in the Procurement Regulations 2024. Bidders must notify the Authority immediately if they are unable to and/or provide accurate and up-to-date information via the Central Digital Platform. 1.4 As part of Stage 1, Bidders must submit a completed Financial Viability Risk Assessment Tool (FVRAT). In addition, and in accordance with paragraph 4.3.4 of this Volume 1, it is the Bidder's responsibility throughout the Competition to disclose to The Authority any change in circumstances which results in a change to the classification of the Bidder's baseline risk assessment, such as a degradation of balance sheet, cash flow, or structural stability, as established in the FVRAT and submitted as part of the Bidder's response to the PSQ. If a change in circumstances occurs, Bidders are required to submit a completed updated FVRAT template to the Authority within five (5) working days. The Authority will only provide responses to Clarification Questions (CQs) relating to the PSQ and COP during the period set out in 4.7 (timetable for the competition) of Volume 1 of the ITT documentation. 1.5 The Authority will use this stage to confirm that neither the Bidder, nor any connected persons, (as defined within paragraph 45 of Schedule 6 of the Act), associated persons relied on to meet the Conditions of Participation, or intended sub-contractors are on the Cabinet Office debarment list. To the extent that any such entities are included on the debarment list by virtue of a mandatory exclusion ground, the Authority will exclude the Bidder from participating in the Competition in accordance with its obligations under the Act. 1.6 In addition, the Authority will consider whether any Bidder (including its connected persons), associated persons relied on to meet the Conditions of Participation, or intended sub-contractors are \"excluded\" or \"excludable\" within the meaning of section 57 of the Act. Before determining whether a Bidder is excluded or excludable, the Authority will provide the Bidder reasonable opportunity to make representations and provide evidence to demonstrate whether the exclusion grounds apply If the Bidder is excluded or excludable only by virtue of an associated person or intended sub-contractor, the Authority will notify the Bidder of its intention to exclude the Bidder and provide reasonable opportunity to replace the associated person or sub-contractor. If, as a consequence of this process, the Authority excludes the Bidder from participating in the Competition or is aware of an associated person or sub-contract having been replaced, it will give notice within 30 days of its decision to the Procurement Review Unit (PRU) in accordance with section 59 of the Act. 1.7 The Authority will undertake a review of the completed PSQs received from Bidders, by reference to information held on the Central Digital Platform. Responses to the PSQ will be assessed in accordance with the corresponding evaluation methodology as described in more detail in the PSQ. 1.8 Stage 1 will conclude with Bidders being notified in writing of whether or not they have been successfully shortlisted to participate in Stage 2 of the Competition. 1.9 Any Bidders not invited to Stage 2 will be provided with a written explanation of the reasons why they have not been shortlisted. 1.10 In the event of a change in circumstances during the Competition that has (or could have) affected the information submitted previously in a Bidder's response to the PSQ, the Bidder must inform the Authority promptly of such changes and the Authority reserves the right to re-assess any response to the PSQ accordingly. 1.11 Bidders are required to make declarations as part of Stage 1 which will continue to have effect throughout the Competition. In accordance with Regulation 6 of the Procurement Regulations 2024, the Authority will obtain confirmation from the Bidders that any updated or corrected core supplier information has been shared with the Authority and has also been uploaded to the Central Digital Platform. 1.12 The Authority reserves the right to adjust the proposed weightings assigned to each evaluation question, and their associated cost elements as part of the PQP calculation, prior to the commencement of Stage 2. In particular, Digital, Over-Heads and Pass-through costs are currently being reviewed for this Competition but will still form part of the evaluation and will be considered when assessing bid price against the Affordability Threshold. Volume 2 and related documents, including but limited to Annexes Q - Financial Response Template, Annex R - Cost Assumptions Questionnaire and Annex S - Financial Response Instructions will be updated following completion of the COP stage. 1.13 Bidders will be notified of any changes made to the approach to these areas of cost, which could include removing some of these cost elements from the PQP calculation. In addition, the weighting of Q1.3b - Digital, is currently being reviewed with a view to removing the weighting and redistributing the weighting across other questions. 2) Stage 2: Invitation to Submit a Tender 2.1 Stage 2 will commence once the Authority has notified Bidders whether or not they have been successfully shortlisted to participate in the next stage of the Competition, following the evaluation of PSQ responses. 2.2 During Stage 2, the Authority will engage in dialogue sessions with each Bidder for the purpose of enabling Bidders to confirm their understanding of key aspects of the Competition and in particular, the Evaluation Questions. To that end, each Bidder will be provided with an equal opportunity to attend dialogue sessions with the Authority to discuss the core requirements of the Competition, and to enable Bidders to develop and improve the content that will be submitted as part of their Tenders. 2.3 The indicative period for the dialogue stage of the Competition is set out in the timetable at paragraph 4.7 of Volume 1 of the ITT documentation. The dialogue stage shall be structured as follows: 2.4 Week 1: this week will commence with an in-person Competition vision session hosted by the Authority (location and timings to be confirmed), as well as a group and individual Bidder site visit to HMP Rye Hill. Further information on how to express interest in attending the vision session and the site visit will be issued via Jaggaer following the conclusion of Stage 1. 2.5 Weeks 2-9: during these weeks, the Authority will host a programme of [mandatory] training sessions (sessions delivered to support bidders with development of their Profiling and FRT aspects of their bid response), with each week dedicated to a different subject matter relevant to the formulation of Bids. In advance of these weeks, Bidders will be invited to express preferences regarding topics they wish to discuss with Authority subject matter experts (SMEs). Each Bidder will have the opportunity to discuss the core requirements of each Evaluation Criterion with Authority SMEs in dedicated 1-to-1 sessions. If it is determined that a topic requested by one Bidder would be beneficial to all Bidders, the MoJ will encourage all Bidders to consider this topic to promote fair treatment. Bidders are reminded of their responsibility to prepare any materials and/or questions for discussion to support the development and improvement of their Tenders. The Authority will also make available additional topic-focused site visits during this period, for example each bidder will receive a Facilities Management focused visit at HMP Rye Hill, with relevant FM data being shared to Bidders in advance.
