Summary of the contracting process

Oxford City Council procured the delivery of a purpose-built affordable housing scheme at 474 Cowley Road, Oxford, OX4 2DP. The works are classified as site-development work and concern the development of this specific former timber-yard site. The requirement covers bringing forward the housing scheme rather than a general housing maintenance or property service. The work is for delivery in Oxford, with Oxford City Council as the public-sector buyer. The selected supplier is Cantay Estates Limited, an Oxford-based small and medium-sized enterprise. The procurement was a single completed lot, marked as suitable for SMEs, and relates to the development opportunity controlled by the supplier at this address.

The procurement has been awarded through a direct award to Cantay Estates Limited and the tender is recorded as complete. The stated legal basis is that the supplier owns the freehold and therefore holds exclusive proprietary rights in the land, making it the only party able to deliver the proposed development, with no reasonable alternative identified. The awarded value is £12,375,000 excluding VAT and £13,750,000 including VAT. The contract period is 14 December 2026 to 13 December 2029, with a maximum end date of 13 December 2030. Two further six-month extensions are available, up to 12 months in total. A contract signature milestone was scheduled for 1 December 2026. A one-time price review may apply if planning consent is delayed, with a Council termination option at that point.

This opportunity indicates demand from Oxford City Council for a developer able to bring forward a purpose-built affordable housing scheme on a specific controlled site, including the associated site-development works. A credible competitor for a future requirement of this kind would need demonstrated ability to develop housing land, manage delivery of a complete development scheme and work within the Council’s affordable-housing objectives. Control of, or secure rights to, the relevant development land may be decisive where a direct award is justified by exclusive proprietary rights. The selected supplier’s SME status and the single-site scope show that the requirement can suit an established specialist developer rather than only a large national contractor, provided it can offer the necessary development capability and capacity.

Procurement Information

Decision to award the contract directly to the Supplier in accordance with the justification contained in Schedule 5, paragraph 5 of the Procurement Act 2023, on the basis that the following conditions are met: " (a) due to a particular supplier having intellectual property rights or other exclusive rights, only that supplier can supply the goods, services or works required, and (b) there are no reasonable alternatives to those goods, services or works." Condition (a) is met because: (1) the Supplier owns the freehold in the land which is subject to the proposed development and therefore possesses exclusive proprietary rights in the land; and The site was formerly occupied by a timber yard and was marketed on the open market by the previous owner, the Order of St John, through Jones Lang LaSalle real estate company. Following this process, Cantay Estates Ltd successfully secured the site through an unconditional offer and now controls the development opportunity. As a result, Cantay Estates Ltd is the only party capable of bringing forward development on this specific site. (2) the Supplier has firmly indicated that the proposed development could only be carried out by the Supplier and therefore only it can supply the works involved in completing the proposed development. Condition (b) is met because the Council has explored all potential alternatives to the works involved in the proposed development, as detailed below, but has not been able to identify a reasonable alternative.
