Summary of the contracting process

Leeds Teaching Hospitals NHS Trust, through the North East and Yorkshire NHS Pharmaceutical Purchasing Consortium, plans to buy a defined range of unlicensed imported medicines for NHS organisations and other eligible public bodies. The products are licensed in their country of origin but do not hold a UK Marketing Authorisation; they are intended for cases where a patient’s clinical needs cannot be met by a suitable licensed alternative. The supply may include medicines requiring over-labelling and translation. This is a pharmaceutical products procurement, covering supply to participating public-sector organisations across the UK. The framework is intended to give those organisations access to safe, quality-assured medicines and support continuity of patient care and supply-chain resilience.

The procurement is at planning stage: the buyer has stated its intention to establish a framework, and there is no invitation to tender yet. The expected route is a competitive flexible procedure. Previous preliminary market engagement was completed on 5 May 2026; the buyer considers it remains relevant following the change from a planned dynamic market to a framework, and currently plans no further separate engagement. A future notice is expected on 12 October 2026. The framework is planned to run from 1 May 2027 to 31 December 2028, with possible extension to 31 December 2029. The estimated value is £36,095,686.53 excluding VAT (£43,314,823.84 including VAT). The procurement is planned as a single lot.

This requirement is likely to suit medicines importers, pharmaceutical wholesalers and suppliers with the regulatory and operational capacity to import, distribute and supply unlicensed medicines in the UK. Suppliers will need the relevant MHRA licences, authorisations and approvals, and must demonstrate compliance with applicable Good Manufacturing Practice and Good Distribution Practice standards. Capability to provide products requiring over-labelling or translation may be relevant to the defined product range. The buyer intends to assess products and suppliers comprehensively for quality, risk and commercial factors, with the stated aims of regulatory compliance, resilient supply, continuity of patient care and value for money across the NHS. Small and medium-sized businesses are identified as suitable, as are voluntary, community and social enterprises.

Notice Title

NEYPPC Pharmacy - Unlicensed Imported Medicines (wave 2)

Notice Description

The North East and Yorkshire NHS Pharmaceutical Purchasing Consortium intends to establish a framework agreement for the supply of Unlicensed Imported Medicines on behalf of NHS organisations and other eligible public sector bodies. The framework will provide access to a defined range of unlicensed imported medicines, including products requiring over-labelling and translation. These medicines do not hold a UK Marketing Authorisation but are licensed in their country of origin and may be imported and supplied in accordance with Regulation 167 of the Human Medicines Regulations 2012 where a patient's clinical needs cannot be met by a suitable licensed alternative. Suppliers will be required to hold all relevant MHRA licences, authorisations and approvals necessary to import, distribute and supply unlicensed medicines within the UK, and to demonstrate compliance with applicable Good Manufacturing Practice (GMP) and Good Distribution Practice (GDP) standards. The framework will provide participating organisations with access to safe, compliant and quality-assured products through a robust and competitive procurement arrangement. Products and suppliers will be subject to comprehensive quality, risk and commercial assessment to support regulatory compliance, supply chain resilience, continuity of patient care and value for money across the NHS.

Planning Information

Preliminary market engagement relating to this requirement was previously undertaken and notified under PME Notice Reference 2026/S 000-037341 in connection with the originally proposed Dynamic Market procurement route. The requirement, scope and anticipated market offering remain materially unchanged from those previously communicated to the market. The principal change is the decision to procure the requirement through a Framework Agreement rather than a Dynamic Market. As the Consortium considers that the previous engagement remains relevant and adequate in informing the procurement approach, no further separate programme of preliminary market engagement is currently proposed. This Preliminary Market Engagement Notice is therefore published to ensure transparency regarding the revised procurement strategy and to notify the market of the change in route.
