Summary of the contracting process

East Riding of Yorkshire Council is procuring independent Best Interest Assessors to carry out Deprivation of Liberty Safeguards (DoLS) assessments under the Mental Capacity Act 2005. Assessors will support statutory assessment work for vulnerable adults across the East Riding of Yorkshire and, occasionally, outside the county. The service is provided through a framework, with assessors invited to undertake assessments on the council’s behalf. This is health and social work provision, particularly suited to independent professionals or organisations able to deliver best-interest assessments for adults whose liberty may be restricted. The framework is designed to add providers through recurring admission rounds during its term.

The council invited offers through an open procedure for a single-lot framework. The enquiry deadline was 25 August 2027 at 12 noon, and the submission deadline was 1 September 2027 at 12 noon. The stated estimate is £2,503,200 excluding VAT (£3,003,840 including VAT). The initial contract period runs from 1 November 2027 to 6 November 2028, with two further 12-month extension options and a maximum end date of 6 November 2030. Price and quality each carry 50% of the evaluation weighting. Providers are assessed in annual rounds; for the third round, evaluation is due in September 2027, with outcomes notified in October and successful providers joining from November. Existing framework providers do not need to reapply.

In order to support in complying with the statutory requirement, the commissioner (East Riding of Yorkshire Council) is procuring the services of Independent Best Interest Assessors (BIAs) to assist in the completion of Deprivation of Liberty Standards (DoLS) assessments. This will be achieved through the provision of Best Interest Assessors, on an open Framework Agreement, who will be invited to undertake DoLS assessments for the purpose of the Mental Capacity Act 2005 on behalf of vulnerable adults across the East Riding of Yorkshire, and occasionally out of county. This is a Pseudo Open Framework under the Light Touch Regime for the provision of Independent Best Interest Assessors and will be opened once every 12 months during the duration. Following the tender initial tender deadline a new tender will be advertised, for continuity and submissions can be made at any time, however, please note they will only be evaluated once every 12 months. The third deadline for submissions will be 12 noon on 1 September 2027. The evaluations for the third opening will be completed during the month of September 2027 and service providers notified of the outcome of their submission prior to the start of the following month e.g. submissions in September 2027 will be notified in October 2027 and will join the framework from the beginning of November 2027. This procedure will remain the same each year during the lifetime of the Framework agreement. (i.e. a new tender to be advertised after each deadline until the penultimate year of the Framework agreement). Service providers who have been appointed onto the Framework following the initial opening (and subsequent openings) do not need to resubmit and will remain on the Framework.
