Summary of the contracting process

Sport England, acting on behalf of the Sports Councils, intends to commission a review and revision of the Transgender Inclusion in Domestic Sport Guidance. The work is to assess the guidance from scientific, medical and policy perspectives, drawing on the existing guidance and related background research, including the 2021 international research literature review. The revised guidance is intended to help national governing bodies and other organisations in the sport sector develop policies on transgender inclusion. This is a research and policy review service, rather than a request to deliver sports facilities or sporting activities. The procurement is arranged as one lot. The buyer is Sport England; the guidance is for use across the sports sector, with no particular delivery location stated.

This is at the planning stage: Sport England has set out its intention to procure, but has not yet issued the invitation to tender. It expects to use an open, below-threshold competition. The planned procurement is due to go live on 8 October 2026, and the stated bid closing date is 16 November 2026; these are the buyer’s expected timetable, not current response deadlines. The contract period is planned to run from 11 January to 10 July 2027. The process is divided into one lot. The published selection information asks interested parties to follow instructions to access the tender, while submission arrangements are to be set out in the tender pack. No contract value or evaluation weighting is stated.

The work is likely to suit research and advisory suppliers able to bring credible expertise across scientific evidence, medical issues and sports policy, and to turn that evidence into practical guidance for national governing bodies and other sports organisations. Experience reviewing existing policy against current research and legal or regulatory developments would be relevant to the brief, which follows changes in the legal context and a decision by the Sports Councils that a full review is required. Suppliers should be prepared to produce revised guidance that supports policy development across the sport sector. The planned competition is open, with one lot, so the brief is not divided into separate specialist packages. Interested suppliers are expected to obtain access instructions from Sport England before the tender is launched.

Notice Title

SE1286 Transgender Inclusion in Domestic Sports Guidance Review

Notice Description

The Sports Councils commissioned and published the Transgender Inclusion in Domestic Sport Guidance in September 2021. The Guidance is supported by several background documents, including the Transgender International Research Literature Review 2021. In April 2025, the Supreme Court Ruling (For Women Scotland Ltd V The Scottish Ministers) ruled that, under the 2010 Equality Act, the protected characteristic of 'sex' means a person's biological sex. The updated Equalities and Human Rights Commission Statutory Code of Practice for services, public functions and associations became legally binding on 5 August 2026 and provides guidance as to how the Equality Act 2010 should be applied. Following advice from legal counsel, and a literature review on the topic, the Sports Councils CEOs agreed that a full review is required. Sport England (on behalf of the Sports Councils) now seeks to appoint a supplier to review and revise the Transgender Inclusion in Domestic Sports Guidance from a scientific, medical and policy standpoint, to guide National Governing Bodies of sport (NGBs) and others in the sport sector to create transgender inclusion policies INSTRUCTIONS FOR INTERESTED PARTIES: To receive instructions on how to access the Procurement opportunity which is due to go live on 8th October 2026, please email Procurement@sportengland.org on or before 7th October 2026. Sport England will provide instructions on how to register your interest on the Sport England esourcing portal ahead of the opportunity going live on 8th October 2026.
