Summary of the contracting process

NHS England commissioned specialised mental health services for adult men in medium-secure care: one service for deaf patients and another for patients with acquired brain injury (ABI). The patients are liable to detention under the Mental Health Act, and their risks of harm to others and escape cannot be safely managed in other mental health settings. The requirement is to maintain safe care and continuity for these highly specialised patient groups. Services are to be delivered in Derbyshire and Nottinghamshire. This is a health-services contract covering both specialist service areas, rather than a general mental health provision. The work also involves transferring staff, estates and operational responsibilities to support stable service delivery.

NHS England awarded the contract to Northamptonshire Healthcare Advanced Foundation Trust; the award is active and the tender is complete. The award date and contract start date were 15 September 2026. The contract runs to 31 March 2030, with an option to extend for a further two years, to 31 March 2032. Its estimated value for the initial term is £34,629,152.88. NHS England used an urgent-circumstances procedure under the Health Care Services (Provider Selection Regime) Regulations 2023, without a prior competition, because regulatory action affected the incumbent’s ability to deliver and a full procurement could not be completed in time to ensure continuity. Evaluation assigned 100% to addressing immediate safety and care-quality risks and 0% to cost.

This award shows demand for providers able to deliver medium-secure mental health care tailored to adult men who are deaf or have acquired brain injury. Credible competitors would need the specialist clinical capability and secure-care arrangements to support patients detained under the Mental Health Act whose risks cannot be safely managed in other mental health settings. The service must address risks of harm to others and escape while maintaining safe, continuous patient care. The chosen provider must also be able to manage the transfer of staff, estates and operational responsibilities, so experience in complex service transitions and maintaining stability would be commercially relevant. The buyer’s stated decision basis puts immediate safety and quality of care ahead of cost; suppliers should therefore be able to demonstrate how their service protects both.

Lot Information

Lot 1

This contract has been awarded under the urgent circumstances provision of
the Health Care Services (Provider Selection Regime) Regulations 2023.
For the avoidance of doubt, the provisions of the Public Contracts Regulations 2015 do not apply to this award.

The contract relates to the provision of Specialised Mental Health Adult Male Medium Secure Deaf and Specialised Mental Health Adult Male Medium Secure Acquired Brain Injury (ABI) services. Patients are liable to be detained under the Mental Health Act and their risk of harm to others and risk of escape from hospital cannot be managed safely within other mental health settings.

This contract has been awarded following regulatory action affecting the incumbent provider's ability to continue delivering the services in accordance with contractual requirements. The circumstances created an immediate need to secure continuity of highly specialised services and maintain safe patient care arrangements.

A full procurement process could not be undertaken within the timescales required to ensure continuity of service provision. NHS England therefore applied the urgent circumstances provision under Regulation 14 of the Provider Selection Regime Regulations 2023.

The contract will run from 15 September 2026 to 31 March 2030, with the option to extend for a further two years until 31 March 2032.

The longer contract term reflects the highly specialised nature of the services and the requirement for transfer of staff, estates and operational responsibilities, supporting service stability and continuity of care for patients.

Estimated lifetime contract value (15 Sept 2026 to 31 March 2030):PS34,629,152.88
