Summary of the contracting process

NHS Golden Jubilee commissioned a replacement programme for the building-management system controllers at Golden Jubilee National Hospital in Clydebank. The work covers 110 DR controllers and 135 TC controllers within the hospital’s existing Johnson Controls system, which runs on a legacy N2 communications network. The requirement is to replace the controllers while preserving the existing control applications, strategies and operating settings. This is specialist building-controls and electrical equipment replacement work, rather than a general hospital maintenance contract. The site’s installed system and proprietary communications and software are central to the scope: the replacement must work with the hospital’s existing controls environment and maintain its operational continuity.

The procurement is complete and the contract was awarded to Johnson Controls. NHS Golden Jubilee used a limited procedure without a prior competition, on the stated basis that technical reasons left no reasonable alternative supplier: the existing controllers use Johnson Controls’ proprietary network, software and licences, needed to extract and migrate the live applications. The contract value is £75,168.74. It was signed on 28 September 2026. The work covers 110 DR controllers and 135 TC controllers and was required to be completed by 31 March; the notice does not state the year for this deadline. The contract is active. The procurement is a single lot, and the published rationale identifies technical capability and access to proprietary systems as the reason for selecting the supplier.

For suppliers preparing for a similar requirement from NHS Golden Jubilee, credibility would depend on demonstrable expertise with Johnson Controls’ installed building-management system, its DR and TC controllers, and the legacy N2 network. The successful supplier was selected because it could access the proprietary software and licences needed to recover and migrate existing controller applications, control strategies and operating parameters. Competitors would therefore need to show they can perform that migration without compromising system integrity or continuity of hospital operations. The buyer considered alternative provision to entail reverse engineering, application re-creation and disproportionate technical risk. This is a tightly system-specific controls replacement, so broad electrical maintenance experience alone would not address the central technical requirement; evidence of authorised access and practical capability with the installed platform would be key.

This is a Voluntary Ex Ante Transparency (VEAT) Notice. This is a Voluntary Ex Ante Transparency (VEAT) Notice. The National Waiting Times Centre Board (Golden Jubilee) intends to enter into a contract with Johnson Controls plc as the only supplier capable of meeting the Board's requirements. In accordance with our interpretation of the Public Contracts Regulations 2015, the required services can only be provided by a particular operator for technical reasons. The main site at the Golden Jubilee Hospital comprises of a JCI BMS which operate on Legacy N2 communication networks. The requirement is specifically for a replacement programme of 110 DR controllers as well as 135 TC controllers with works requiring to be completed by March 31st. Additional information: This will be governed under the GJ Standard Terms and Conditions for services.

Procurement Information

Under Regulation 33(b)(ii) of the Public Contracts (Scotland) Regulations 2015, competition is absent for technical reasons. The National Waiting Times Centre Board (Golden Jubilee) is satisfied that Johnson Controls is the only provider capable of meeting the Board's requirements for the replacement of the existing controllers on site. The installed system comprises Johnson Controls DR field controllers operating on the proprietary N2 communications network. Recovery and migration of the existing controller applications, control strategies and operational parameters requires access to proprietary Johnson Controls software and licences that are not available to third parties. As the original system manufacturer, Johnson Controls is uniquely able to extract and migrate the live controller software whilst maintaining system integrity and operational continuity. Engagement of an alternative supplier would necessitate reverse engineering and re-creation of the existing applications, introducing disproportionate technical risk and the potential for loss of functionality. The Board is therefore satisfied that no reasonable alternative or substitute exists.
