Summary of the contracting process

Merseytravel commissioned civil engineering consultancy services for Phase 1 design support to the Early Contractor Involvement stage. The work covers additional technical services by the appointed designer, developing the pre-construction design and scope in conjunction with the main contractor. The project includes public realm improvements at Monument Place, which the Combined Authority agreed to undertake instead of Liverpool City Council. The stated rationale is to achieve cost efficiencies and reduce public disruption. Delivery is in the Liverpool area. This is a single design-support requirement tied to the wider project, rather than a general consultancy services framework.

The procurement is complete and the contract has been awarded to Mott MacDonald Ltd. The contract was signed on 17 August 2026, at a value of £119,638.97. The procurement used a limited procedure without prior publication of a competition. The buyer says the additional work could not readily be separated from the existing work, a new tender was not feasible, and foregoing the Early Contractor Involvement stage would pose significant delivery risk amid existing budget difficulties. It also says a further modification of the original contract would exceed the permitted 50% limit after two earlier modifications. The work was arranged as one lot. No separate evaluation criteria are stated.

For firms considering comparable future work for Merseytravel, this award shows demand for specialist civil engineering design support that can be integrated with an existing project team and main contractor. Credible suppliers would need to develop pre-construction designs and scopes, provide additional technical services, and coordinate closely across contractor and public-sector stakeholders. Experience managing design changes and complex interfaces would be relevant, particularly where public-realm improvements must be incorporated into a wider project and delivery risk is a concern. The award also illustrates that this buyer may use an existing-contract modification route where work is closely connected to an original commission and a separate competition is judged infeasible. Suppliers should therefore understand both the technical requirements and the constraints of working within an established contract.

Procurement Information

The initial contract was procured and awarded pursuant to the requirements of the Public Contracts Regulations 2015 ('PCR 2015'). The PCR 2015 provide exemptions under which a contract may be compliantly modified without a new procurement procedure. The original contract has previously been modified twice, a further modification would not be permitted as this would take the total modified cost to over 50% of the original contract value. The predominant cause of the increase in work required under the contract is due to the Combined Authority agreeing to undertake the public realm improvements at Monument Place that were proposed to be undertaken by Liverpool City Council. There is public benefit in doing so due to cost efficiencies and reduced public disruption. Consideration has been given to alternative arrangements but the proposed additional work cannot be easily discoupled from existing work. A new tender process is not feasible in the circumstances. Officers believe that failing to undertake an ECI stage will create a significant risk to the deliverability of the Project given the budget difficulties it already faces.
