Summary of the contracting process

Airedale NHS Foundation Trust, through its wholly owned subsidiary AGH Solutions Limited, required replacement compressors for the air source heat pumps serving the modular Intensive Care Unit at Airedale General Hospital in Keighley. The pumps provide heating and environmental support to accommodation for critically ill patients. Specialist engineering assessment found significant compressor failures, despite the system being commissioned around five years ago and not expected to be at the end of its operational life. The requirement covers supplying and replacing the failed compressor components to maintain the heat pumps’ resilience and functionality, supporting continuity of critical care. The early failures are being investigated with the original building constructor and associated parties, including possible warranty or contractual responsibilities; that investigation does not change the immediate replacement requirement.

The procurement is complete and Mitsubishi Electric Europe B.V. was selected as supplier through a direct award. The stated reason was urgency: compressor failure could threaten critical healthcare services, and the replacement lead time made a competitive tender incompatible with the need for prompt action. The award value is £133,759 excluding VAT (£160,510.80 including VAT). The contract period runs from 1 November 2026 to 31 March 2027, with the award dated 16 October 2026. There is one lot, covering the air source heat pump compressor requirement. The award is recorded as pending, and a contract signature was scheduled for 1 November 2026. The stated basis for the decision was the immediate risk to patient safety and service continuity, and the need to limit the direct award to the work required to address that risk.

For suppliers considering similar future requirements at Airedale, this award demonstrates demand for specialist compressor replacement and support for air source heat pumps serving critical hospital accommodation. A credible competitor would need relevant technical expertise to assess failures, source compatible replacement components and carry out the necessary mechanical and electrical installation while protecting heating and environmental conditions in an operational intensive care setting. The buyer’s urgency rationale indicates that response speed and dependable component supply are commercially important, particularly where long lead times could affect continuity of care. Experience working in live healthcare environments, coordinating safely with hospital facilities teams, and restoring system resilience would strengthen a supplier’s position. Manufacturers or service providers able to combine equipment access with specialist engineering and installation capability are best placed to meet this specific requirement when it recurs.

Notice Information

Notice Title

Air Source Heat Pumps (ASHPs)

Notice Description

AGH Solutions Ltd requires the urgent replacement of compressors within the Air Source Heat Pumps (ASHPs) serving the modular Intensive Care Unit (ICU) facility. The ASHPs provide critical heating and environmental support to accommodation occupied by critically ill patients. The modular ICU facility and its Air Source Heat Pumps (ASHPs) were commissioned approximately five years ago and should not yet have reached the end of their expected operational life. However, a specialist engineering assessment has confirmed significant compressor failures requiring replacement to maintain system resilience and functionality. The premature failure of these components is currently being investigated with the original building constructor and associated parties to establish the underlying cause and determine any contractual or warranty implications. Notwithstanding these ongoing discussions, the Trust must take immediate action to ensure continuity of critical care services and cannot delay replacement whilst liability and remedial responsibilities are being determined. Replacement compressors are subject to an estimated lead time of 8-10 weeks. Any delay in placing an order would materially increase the risk of component failure during the winter period, potentially affecting the environmental resilience of accommodation used to support critically ill patients. Total amount: PS133,759.00 excluding VAT

Procurement Information

The proposed direct award is made pursuant to Section 41 of the Procurement Act 2023 and the urgency justification contained within Schedule 5. The Trust considers that: There is an immediate and substantial risk to the continuity of critical healthcare services should the compressors fail before replacement. The ASHPs support an operational ICU environment occupied by critically ill patients and are therefore directly linked to patient safety and service continuity. The lead time associated with obtaining replacement compressors means that any delay in procurement would materially increase operational risk. The urgency of the requirement cannot reasonably be accommodated within the timescales required to undertake and complete a competitive tendering procedure. The circumstances necessitating the procurement were identified through specialist technical assessment and require immediate action to protect continuity of service. The direct award is limited strictly to the scope necessary to address the immediate risk and ensure continued operation of the ICU facility.
