Summary of the contracting process

North Tyneside Borough Council procured continued hosting, support and maintenance for ELMS2, its specialist Loan Equipment Management System. The system is configured for the council’s community equipment loan service. The requirement covers keeping the system hosted and maintained and providing ongoing technical support so the service can continue without disruption. The service is delivered for North Tyneside Council in the North Tyneside area. This is a specialist IT support service (CPV 72000000), rather than a purchase of equipment or a new system. The requirement centres on maintaining the existing ELMS2 platform and its established operational use for the council’s community equipment loan service.

The procurement is complete and the contract has been awarded to ETHICAL TECHNOLOGY LIMITED, which also signed the contract. North Tyneside Borough Council used a direct award without competition, below the threshold, under the stated legal basis of the Procurement Act 2023. The council’s rationale was that Ethitec has the technical knowledge, access and infrastructure needed to maintain ELMS2, and that changing supplier would entail complex data migration, system reconfiguration and user retraining, with significant operational risk. The contract was signed on 1 October 2026 and runs from 2 October 2026 to 30 September 2029. Its value is £37,842.13 excluding VAT and £45,410.56 including VAT. There was one lot, covering the service requirement.

This award shows demand for continuity-focused support of a specialist system used to manage community equipment loans. A credible competitor for a future requirement would need proven technical knowledge of the relevant platform, the access and infrastructure to host and maintain it, and the ability to provide dependable ongoing support without interrupting council operations. The buyer’s stated concerns also make safe data migration, system configuration and user transition central capabilities for any supplier seeking to replace an incumbent, alongside experience managing operational risk in a live public service. Suppliers whose offer is limited to generic IT support, without the ability to maintain this particular system and manage continuity risks, would be less well placed. The procurement route reflects the council’s view that technical continuity and the absence of a reasonable alternative justified a direct award in this instance.

Notice Information

Notice Title

Renewal of Annual Support, Hosting and Maintenance of ELMs2 - Loan Equipment Management System

Notice Description

North Tyneside Council intends to directly award a contract to Ethitec for the continued hosting, support and maintenance of the ELMS2 system. ELMS2 is a specialist system configured for the Authority's community equipment loan service, and Ethitec is the only supplier with the technical knowledge, access and infrastructure required to maintain the service without disruption. Changing supplier would require complex data migration, system reconfiguration and extensive user retraining, creating disproportionate technical difficulties and significant operational risk. The Authority therefore considers there are no reasonable alternatives capable of ensuring continuity of this critical service.
